I will keep on fighting for justice for my son

You will see from the photos that my son Zachary was killed in a car crash. He was a passenger in his best friends Luke's car. As they went to overtake a colleagues car Dan, Dan reacted in a competitive way and would not let them past. This resulted in the instant death of Zach and devasting injuries to Luke. Dan admitted responsibility in the 999 call, to the police at the scene and to a colleague during a phone call. For 18 months I have fought for justice for my sons death which resulted in a 4 day court trial at Leicester crown court on the 4th April 2016. Unfortunately the CPS who have acted appallingly throughout (complaint pending) decided at first to only charge Luke who was actually a victim so I campaigned for him not to be charged. Eventually both went to court charged with causing death by dangerous driving. Despite Dans admittance of guilt he was found not guilty. Dan shows absolutely no remorse for what he has done he has lied throughout and for 18 months following his first 3 comments has said "no comment" at the advice of his solicitor. I am utterly devastated by the my sons death and the fact that Dan goes unpunished . I read in the papers everyday that people have been punished with prison, fines, driving bans and restorative justice for crimes that have not resulted in the death of an innocent victim. Life for me is a constant, constant, constant injustice! Please help me and sign my petition www.change.org/p/uk-justice-system-justice-for-zach?recruiter=21342039&utm_source=share_petition&utm_medium=copylink

Well if I were the OP, being told to 'move on' from the death of my child, it might not add to my sense of happiness...

I didn't 'automatically' sign.
I looked at the two statements made by Dan.
I understand that the jury will have had far more info. upon which to decide.

However I also know that there can be big miscarriages of justice not infrequently.

So I felt I could support Cathy's attempts to get this looked at again.

Whether this helps her 'move on' (ugh!) is not for me to say.

Fraser's father has, I believe, been charged with harassing the family of the driver whose actions killed his son.

Signed. Sorry for your loss. Flowers

Hi thank you everyone who agrees and signed the petition.

Thank you to those who have simply read it and not signed too.

For those people who have added their interesting and somewhat surreal perspectives.

I have stated that I don't want anyone to go to prison (an eye for an eye as one of you put it). Someone even blamed my son even though he was just a passenger.

Some of you question the feelings of Dans parents.

As a parent yourself, do you agree with the following phrase?

"People must FACE the consequences of their own actions"

I'm so sorry Hygge to read your story.

PirateSmile · 21/04/2016 11:46

Are you getting any legal advice at the moment Mrs. Whittall?

Hygge · 21/04/2016 12:31

Thank you. I don't want to take the thread away from it's real purpose, or shut down the discussion, please don't think that's why I posted.

It's just that to me, the loss of my children is like no other loss I've ever experienced, it changes you and becomes a part of you in a way I've never expected or experienced before. It's something that is always with you and something which becomes a part of who you are.

And it's important to me to try to explain why, in situations like this when someone is responsible for your loss, it matters to have the truth known or the apology made or the explanation given.

You need to know you've done your best for your child. And Mrs Whittall, I really believe that you have. Flowers

Thanks for your lost children.

BeccaMumsnet · 21/04/2016 13:20

Hi all - we're going to move this over to our Petitions topic.

70isaLimitNotaTarget · 22/04/2016 22:17

I have read this thread Chwittal and Flowers it is heart breaking.
I have a teenage son and the thought of him driving or going out with one of his mates behind the wheel fills me with trepidation.
I cannot begin to imagine the horror of what you are experiencing every day.

I'm bumping this because things move very slowly on this Topic, MNHQ shift threads over to Petitions but it;s not a Topic that's easy to find.
