If I type the Theft Act 1968 in a sentence and in a subesequent sentence refer to it, does it have a capital A? eg Under the act, the defendant or under the Act, the defendant?

Yes (in my experience of referring frequently to acts of Parliament at work!).

"act / acts" - refers to acts in general.
"Act" - refers to a specific act.
