Hi all,

My previous post was deleted.

I need advise on how I can share/ have the custody of my child.

I am on the child's birth certificate.
She goes away on mutual understanding but then extends her stay without any warning. I did go to Liverpool to visit my child but only for a couple of hours as I do not know when my wife was returning and I was missing my child.

I haven't taken any legal advise yet and would appreciate if anyone can share what are my legal rights as you all know legal is very costly and I have a normal job.

If you're on the birth certificate you technically have a legal right to equal access to your child however if the mother, who seems to the primary carer, doesn't agree you both go to court and a judge will make a decision and a contact order will be granted outlining a contact schedule. The judge would be looking at what involvement you've had with the child, what child maintenance you've paid and your background. It ultimately comes down to what is in the child's best interests and whether that is having equal contact, minimal contact or none the decision will be made in court. Also this may take a long time (year or more) if you both aren't agreeing

Everyone's situation is different so this may not be the best place for advice. Speaking to a solicitor would be much more informative.

I'd speak to your ex and see if you can agree some type of schedule outside of the court.
