Rights regarding maternity leave

Just want to know if I'm currently on maternity leave up until 11th May and am looking to get a place in a nursery but I can't get one, so my work has agreed to additional unpaid paternity leave for up to 18 weeks which would take me to mid Sept, my question is, if I'm pregnant now and take the additional paternity leave, will I be able to entitled to maternity leave again after the paternity leave even if I don't go back to work as baby would be due end of October

You mean parental leave and not paternity leave I take it?

yes you will be entitled to take maternity leave again but you may not be entitled to any pay.

Can you look at things like taking holidays, starting your next mat leave at 29 weeks etc, to mitigate the impact?

If you are unpaid during the qualifying weeks you would only get Maternity Allowance.

You need to separate maternity leave from maternity pay/allowance.

Importantly, does your employer offer enhanced maternity pay which would be at risk if you haven't worked xxx weeks prior to EDD?

Do you have a partner, could they be the one to take unpaid parental leave? PP is right about salary in the qualifying weeks.

Dyslexicwonder · 28/02/2023 13:52

Do you have a partner ? It would be much better if they took the parental leave and you return to work so can then get full maternity pay.

Have you had a full year off by mid May, OP?

Mamabear04 · 28/02/2023 15:14

You could always ask your employer "does the paternal leave affect any other leave?" Then you have their response in writing if you ask via email.

Call pregnant then screwed for advice!

SheilaFentiman · 28/02/2023 17:06

@Mamabear04 it’s not so much the leave as the pay.

PinkFrogss · 28/02/2023 17:15

Look at your work’s family leave policy.

At most places you wouldn’t be entitled to pay, and would need to claim maternity allowance.

All women who give birth are entitled to maternity leave, that is a day one right. It’s the pay you may not be entitled to

Viviennemary · 28/02/2023 17:19

No I don't think you would be. You would essentially be on unpaid leave if I understand correctly.

Twizbe · 28/02/2023 17:33

You'd be entitled to the leave, but you won't be earning anything during the qualifying period.

If possible I'd wait until after you return to work to get pregnant again.

Viviennemary · 28/02/2023 17:41

Yes I agree. You will get the leave I think but won't qualify for the pay.
