Is this discrimination?

New head teacher comes in first week back.
Second week in we get stuck in traffic for over an hour for what would normally take me 15 mins max. Daughter gets a lunch time detention, even though I rang to explain, road works, traffic light issue etc. Issue out of her control. My child was not the only one. Probably 1/3 of the school. But those on the school bus do not receive the same sanctions as they are deemed in school once on the bus??
I've made a complaint but school are standing firm on this.
AIBU to think this wrong?

When my children used the school bus, they were registered on the bus... if it was late they weren't

Should the school have punished for an extreme issue... if it was really a third they should have used common sense but its not really discrimination

YABU to consider this discrimination. Discrimination is being treated unfairly for a specific characteristic - commonly those recognised in the Equality Act. Unless your daughter is disabled which is why she's driven to school then you'd be hard pressed to pursue a discrimination complaint.

YANBU to think the school should use common sense with things like this - although with my daughter's school if you're not on the school bus it's because you're close enough to walk so exceptional and unplanned bad traffic wouldn't be considered a good reason to be late for school unless on the school bus.

Do you actually understand what the word discrimination means? You shouldn’t really be bandying words around when you clearly don’t know the meaning. But you tell school it’s discrimination, I bet they could use a laugh.

It's discrimination because there are np protected characteristics here.

I do think the school is wrong though.

ChardonnaysBeastlyCat · 16/01/2023 11:00

It's NOT discrimination!

What a typing mistake!

This is the reasons I asked, I struggled through out my school life and still do and comments like yours make me feel really insignificant. So I hope I gave you a good laugh and have a lovely day!

Don’t throw that term around, it refers to people being treated less favourably due to a protected characteristic. It makes you sound dramatic and over the top
You probably mean unfair, which is may well be but if so calmly tackle it instead of throwing incorrect words around

custardbear · 16/01/2023 11:37

The school are being idiotic in this situation as it was clear there was an unexpected issue - it's not discrimination though

RunningDownADream · 16/01/2023 11:46

Discrimination has more than one meaning and the OP’s example easily fits into a definition of the word where it means the quality or power of finely distinguishing or even the act of making or perceiving a difference (ie I am discriminating in my reading choices).

The children’s punishment for their lateness discriminates (differs) on the basis of their method of transport.

I can’t see where she claims they were discriminated against due to a protected characteristic under the Equalities Act, which would be incorrect. (As far as we know).

It's not discrimination but it sucks. I would pick her up at lunch and go out for a lunch together rather than let her do undeserved detention. I'd tell the school she'll only do detention if all the other pupils who were equally late get the same punishment.
