i keep this as simple as possible. My friends ex partner who has never lived with her but had a child with her, constantly shows up at her home and every time refuses to leave her home. He thinks that as his daughter lives there he can do this. Is this correct does he legally have a right to be in her home does having a child with my friend give him legal rights to enter the home even if she asks him to leave or says no to enter? She has tried to arrange contact where he has the child over night so it’s not like she refusing contact.

please can someone advise as she getting really down with the situation as he won’t let her live her life and move on etc. it’s very toxic for her and the other children we based in the uk

No. He doesn't even have a right to know where she lives. Does he have a key?

Quitelikeit · 30/11/2022 21:30

No.

she needs to stop letting him in.

TeaAndJaffacakes · 30/11/2022 21:32

Not unless he co-owns the house.

Don't let him in. Call police if he kicks off.

Tell them he has never lived there and is harassing her.

Theunamedcat · 30/11/2022 21:33

No not at all she can call the police and have him removed

My ex husband has no rights to enter my house even though its the former matrimonial home his name was never on the tenancy and once he left that was it

GreenManalishi · 30/11/2022 21:44

No. He has no rights to enter the home and she does not have to answer the phone or go to the door never mind let him in. If she can afford a ring doorbell or similar it might help.

If she emails him or writes to him and states clearly and calmly that he is not to come to her address and if he persists it will be taken as harrassment and the police will be involved. Follow through and call the police if he turns up, and be consistent with the message.

Don't let him in. Don't take any messing. Nobody has a right to enter a house unless they own it or part of it. If they are not married and he's not on the lease, or mortgage, then it's a definite No.

Same as the others. Not unless he co owns it and even then the police would probably advise he leaves

Bigfamilymum · 01/12/2022 08:58

Ok next question. He is not violent etc just won’t leave. If she has had dealings with social services before and no longer does would calling the police to remove him cause social services to come back into her life?

Someone that "just won't leave" should not allowed into the house in the first place.

If she doesn't want to involve the police that's the easiest route. Don't let him in.

Caroparo52 · 26/06/2023 13:50

Call the police to get him removed from the front door. Under no circumstances should she put up with this shit. If he won't play ball with the proper contact routes then he doesn't see his kid. Citizens Advice offer free legal advice too
