Child Maintainance Calculation. My ex is lying

Hi. Just wondering if anyone has advice for me.

I have recently made an application for Child Maintainance. My ex has a good job and it has been calculated that he earns £1047 per week.

I have one child and he never sees him. He lives with his wife, his two biological children and another child who has a different father.

My ex is claiming that he is no longer with his wife, and paying a family based arrangement to her for 3 children (even though they only got married two months ago and are clearly still together according to Facebook). This has reduced the payments I should receive by almost half from £408 per month to £205.

How can I prove that a) he isn't the father to the oldest child and b) that he is in fact with his wife and doesn't pay maintainance for the children?

If he claims they have split up last week and he then starts paying a monthly amount into her account how can I prove anything? I'm so upset he is being so deceiving.

You can dispute your case directly to CMS. Via the online account you can submit evidence - screenshots of his facebook profile etc. What you do need though is explicit evidence that they are in fact living together, which may be harder to get. Regardless it is worth you submitting all evidence you have and allow CMS to make a decision. It worked for my partner when there was lies from his ex and once evidence was submitted they ruled in his favour.

Sorry - I also note you say he is paying for the 3 children with his wife. Unless he has PR for the non-bio child this cannot be taken into account for the calculation. CMS could based on your evidence ask for him to provide bank statements indicating the payments to his wife, but as its only been a week there could only be max 1 surely which wouldn't help?

If he is on a joint claim with her for universal they would get caught out.
She would have to claim that he doesn't live there to them.
Child benefit number is what they need to prove he is the father to the other dc
