Returning to work next year.... Annual leave?

Not sure where to post.....
I am currently on maternity leave from my company (which I hate) I have used my annual leave for this year and have added it into maternity leave, which I started in march
I am due to return to work next march but was wondering if I would be entitle d to the 28 days annual leave I aquire each year? For example could I take 28 days holiday and then not return? Cheeky I know but they really did treat me like shit and the thought of going back makes me want to cry!

If your leave year starts January and you return 1st March then you only accrue Jan and Febs quota of holiday. If full time its usually a days leave a fortnight, so that would be four days AL.

So you earn Leave as you work. You dont get it all allocated at the start.

If you leave at the end of your Maternity Leave (am working on 1st March as an asusmption) you will only have accrued around four days. You could either hand your notice in a month before, so 1st Feb, if you need to give a months notice, and then be paid the four days AL, or could hand your notice in on 5th Feb and have the first four days in March as AL.

This is all a loose example as obviously I dont have copies of your works contract or policy.

To clarify, if your annual leave year runs Jan-Dec and you leave at the end of your Mat Leave end of Feb, you wont then receive the whole years entitlement of AL, as you havent actually worked (or been on mat leave) for more than two months.

Remember you 'll have to pay back some mat pay unless u return for a certain amount of time- my work it is everything over smp unless return for 3 months

Yes, you accrue all of your leave whilst on maternity and, as you werent there to take it, you can carry it over as they cant treat you unfavourably because you were on maternity leave. So you can take it at the end of your maternity leave.

Only if she has received anything over the statutory. Not a lot of places pay over the governement minimum.

Depends on when the leave year starts and ends.

If it starts and ends in april then she will have a full years worth to use. If jan then she wont.

I recieved 6 weeks at 90% then SMP for the rest, other people have not returned and not had to pay anything back as far as I am aware? Might have to cut my losses for the 4 days, they would do anything they could to not pay it to me anyway, probably more hassle than what it's worth to
Even ask. I have used all of this years entitlement, they allowed me to add as many days a month to my SMP which has been very handy for topping up the payments each month

If you have leave owing when you resign just ask for it to be paid.

I just add a sentence to my resignation saying....I have calculated I have four days annual leave remaining, please add this payment to my final salary.

Dif yo habe used all this years up, then no you won't have any for next unless you have accrued it. If you take it and then leave, then it will get stopped out of your last month's wages.

You won't need to pay any matpay back as you only got the minimum.

You will have accrued annual leave as if you had been at work every day of mat leave, pro rata as other posters have said, so it depends how the company works out annual leave.
