I am sure this has been discussed over and over - and many people have different stories but I would just like a simple answer.

I have recently re-married and live with my new husband, our son and my two boys from a previous relationship. My two boys spend roughly 50% with their father.

I dont receive any money from my ex as the boys spend an equal amount of time with him - I am only working part time and am finding it tight - do you think i am entitled to some maintenance?

You seem as though you know you are being ridiculous so I will assume that you have got into a mess with your CC. If that is the case then asking for money from your Ex isn't the way to solve this. There are lots of posters on here who can help you especially if you try the Money board.

so - if i got monthly payments through CSA (or private agreement) i would be expected to look after all costs associated with the children.

I am just trying to work out what would work better for us all - perhaps if I got monthly payments I could budget better. so maintenance payments should cover all big items (school trips, uniforms, clothes etc) and anything he buys on top of that would be up to him - but i would be fully responsible for providing for everything the kids need (with his financial support?)

Or do the maintenance payments help with roof over head, food, heat etc - and the extras (uniform, school trips etc) are split evenly?

He would be liable for 20% of his salary, after tax, less the reduction for overnights, which would be quite a bit.

You can spend this on what you want.

He doesn't have to pay for anything else.

How much does he earn?

he is probably on about £40,000 - less after tax i suppose.

I think this will help me budget - but i may be worse off Confused

That would reduce it to £136 per month.That's the total amount for both children

I really think that this would open such a massive can of worms that the negatives would very easily outweigh the positives.

You came to a mutual agreement with your ex regarding contact with the children and maintenance. You now want to unilaterally change that agreement because you've overspent on non-essentials. Do you not think that this will cause a massive rift between you and your ex? I wouldn't piss in my ex's mouth if her tongue were on fire but despite that I don't do things that I know would annoy her unless it's absolutely unavoidable.

If I've made a mistake then it's my responsibility to resolve it. I don't try to offload that responsibility onto my ex. If you have debt problems then talk to the likes of the CCCS.

I actually think that if your ExH has the children 50% of the time, he should receive 50% of the CB.
