does anyone have any infomation on the regulations please?

There is one outside my house and one of my neighbours takes his car out of his garage evey day and parks there, he is not displaying a blue badge, although probably has one.

I rung my local council and the first 2 people i spoke to said that a parking ticket could be issued but the 3rd (after i had been cut off and had to call back) said they are only advisory, anyone can park there..etc.

So...anyone know and have any links please?

Unfortunately unless there is a post with a sign next to the bay then anyone can park there. I had this problem with a neighbour of mine parking in the disabled bay for my son. I requested a post and sign and the council put it up making it an offence for the neighbour to park there

madwomanintheattic · 27/03/2009 17:44

he does have to display a badge though... otherwise he can get a ticket and he'd have to appeal against the fine. but yes, unless it has (your) specific details on the sign, any blue badge holder can park there. i routinely use empty residential blue badge spaces for the school run.

Slightly related question, my dad is diabetic and has Charcot foot as a result of surgery. He had a blue badge for a while and was asked if he wanted a disabled space outside the house. He didn't take them up on it but out of interest, what would have happened when his blue badge was revoked? Would they have scrubbed out the space or would he not be able to park outside his own house now?

Sorry for hijack!

madwomanintheattic · 27/03/2009 17:50

lol eyeballs - exactly why we didn't take them up on their offer - we move every two years and i just didn't feel comfortable about the next residents not being able to park lol. i can't see any council being savvy enough to get rid, but no-one could answer me either...

disabled bays are not enfocible unless they have a post and sign, if they don't anyone can park there(so he wouldn't need a blue badge)
Eyeballsinthesky the bay would stay but he wouldn't be able to use it (if it has a post and signh)

NeedCoffee · 27/03/2009 17:51

eyeballs, through research on the net it said that yes, it would be scrubbed out!

he doesn't display a badge, may try ringing council again on mon, the 3rd person just so didn't want to file a complaint at 4.50 on a fri afternoon i don't think.

I don't know who the space actually is for, there are 2 ladies in wheelchairs down my terrace.

madwomanintheattic we moved, I rang the council and told them and explained that parking was really hard at that road, so they painted over it and removed the post, but it keep comming back through

SoupDragon · 27/03/2009 17:53

I've seen them scrubbed out before.

SoupDragon · 27/03/2009 17:54

I think I've seen them burning road lines off with something akin to a hot poker though.

NeedCoffee · 27/03/2009 17:55

is that definate 2shoes?
it says here

Unfortunately, the process to introduce a Traffic Regulation Order (TRO) to enable the bay to be enforced by the Council's parking attendants takes a number of months. This process is unavoidable, and is necessary to ensure that anyone illegally parked in a disabled bay would receive a Penalty Charge Notice (PCN). but that may be just when a sign is up?

it says it on your link

KERALA1 · 27/03/2009 18:03

The council told me that unless there is a sign up displaying the disabled badge the space is courtesy only.

We have one right outside our house which was for the elderly chap we bought the house from. I have been parking in it on and off when unloading or when there are no other spaces (after checking no one else in the cul de sac is disabled) as still waiting for council to paint it out. I have never got a ticket despite the ticket man coming daily.

ThingOne · 27/03/2009 18:05

We have one in our street. It was there for people who moved away. The council was very prompt it painting over it but it then poured for about three weeks. We now have a disabled bay again. The good thing is all the residents know it's not a real one and none of the visitors do .

I was told it won't be painted over again as major works were due in our street. Now they've been postponed for another year!

NeedCoffee · 27/03/2009 18:25

the link was not specific to my council, can't find anything for mine, so i don't know if they all have the same rules.

oh, sorry. i was assuming there was a post and sign. i assumed you meant it wasn't one that specifically said for x permit (ie particular individual). round here the residential ones all have posts and signs with the disabled badge on, but some of them also have the paricular residents permit details so no other disabled badge holder can park there... if that makes sense lol.
