Dumped child outcome?

To cut a very long story short, my brothers xp had a one yr old dd when he met her, 4 years later they went on to have a ds together, a year after that she left him and the children. She took nothing to do with them for 3 years but her mother would sporadically phone and take them for the odd weekend.
In November her mother had them for a weekend and they came home and told us they had a new 3 wk old brother. They had been to see their mother. Just before xmas my brother got a soliciter letter saying the mother of the kids wanted the her dd back (but not ds). My brother eventually agreed to this as the lo (9 yrs old) really wanted this. He or his ds have not had any contact with her since so at present he is taking her to court for parental rights and visitation rights.
Does anyone know how a judge will rule in this case? My brother has no blood ties to this wee girl but loves her like his own, as we all do. He has recieved a letter today from bitches soliciter stating that lo doesn't want to see him and reasons why(probably not true). They are due back in court at end of month after social work reports have been carried out. Just need a wee bit of hope that we will see her again.

I'm no expert but I believe the agencies concerned in these cases are very thorougher and they see through situations where one parent 'poisons' the kids against another.

unfortunately the court will see it as only one natural parent, unless he lawfully adopted her he might not have much of a case.

My worry is that her mother is twisting her head and also that she will be scared that if she does come to us for weekend that she might not get back to her mother. Also she may feel like she is betraying her mother. Really has her on a pedestal
I really hope the social services will see through this.
He did try to get legal gaurdianship a few years but soliciters presented it wrongly to the court and he couldn't afford to go through with it again at that point.
