I currently rent privately, but I’ve broken up with my boyfriend and he isn’t willing to move out. My sister is a landlord for multiple properties and said once her contract is over in March with her current tenants I could go there. She would do it slightly cheaper as I’m her sister, but can I still claim via universal credit housing element if I move there if she treats me as her actual tenant, taking monthly payments and will do a contract etc? I won’t be living with any family there accept my child. I just rather leave as I prefer that house, the area and know I have a bit of security with my sister being the landlord and living round the corner. Any feedback appreciated

Yes, as long as you have a proper tenancy it will be fine. I used to rent from my mum. UC will prob want to do some checks but as long as all above board you wont have a problem.

Thank you, do you know whether I can take myself off the current tenancy once I leave, it’s just an ongoing contract? But my sister is guarantor so I’d rather not have either of us on the agreement once I leave incase he doesn’t pay etc

I think it depends on the tenancy, (whether is fixed or periodical) for fixed you need to have all other tenants & landlord agreement.
If periodic, if you end the tenancy by giving notice then it ends the tenancy for everyone. Will be up to the landlord to issue a new tenancy for just the ex partner.
