Letting Agent Confirmed End of Tenancy Date

Hi all
I rent a house in the West Midlands and emailed agency to say I wanted to give notice. Was told by letting agent that it would have to be a month from when we last paid rent so 28th May, I agreed to this. The letting agent sent an email confirming the end date would be 28th May. I have made arrangements to move and have entered into another contract based on the email from the letting agent. They have emailed today and advised my contract says I am liable until 28th Aug.
As they put it in writing can I insist that they stick to the confirmed date of 28th May for the end of the tenancy?

What kind of tenancy agreement do you have? Is it by any chance that it’s a fixed term agreement until 28 August and you’re asking to end it early? Does it mention a ‘break clause’ at all?

I wonder if there are two separate things going on here - the date you’re moving out and the date your tenancy / liability ends. But it’s impossible for anyone to advise without knowing anything about the tenancy agreement.

It’s an Assured Short Hold Tenancy Agreement until 28th Aug. I asked for 4 weeks notice and letting agency came back with the May date.
No break clause mentioned in contract.
If a date has been confirmed on email for the end of the tenancy can they go back on this?

Unfortunately yes, they can, as you are liable for the tenancy agreement until 28th August. Have a look at anything in the contract about early termination and re letting.

It’s not ideal that they confirmed a leave date to you if this was the case, but - though I am not a lawyer - this alone is unlikely to mean you’re not liable. Did they say it was a date for the end of the tenancy or a date for you to move out?

Get proper legal advice as I am not a lawyer but I do deal with Tenancy Agreements.
I don't think that an error on the part of someone at the agents office would over ride a Legal Agreement you signed though.
There may be some room for negotiation though, for example if they find a new Tenant to take the property asap, which is likely in todays rental market and you just have to pay the agents fees

They have agreed to the May date. Thanks for the advice everyone. I did try to contact Shelter and Citizens Advice but couldn’t get through. Thanks for all your advice.
