I want to leave my husband and have at least 50-50 custody of DS. I have just been on 'entitled to', which is saying I won't get UC all because my share of a rental property we own is over £16k. Obviously this will need to be sold in the divorce but am I really not entitled to UC while I still own it? It's not the same as savings, as there's no access to the capital.

If I don't get any UC, I won't be able to leave, as I don't currently earn enough to rent privately.

Sorry. Just feeling so trapped and desperate.

You are entitled to at least half of marital assets. This includes pensions - which can be more valuable than home equity.

It's just going to be a massive slog to get half. I probably only have enough in savings to rent privately for 4 or 5 months. If I can't claim UC, it's going to be really difficult.

I am also worried I won't pass the income checks without UC. I only earn about £200 more than the average rent for a 2-bed in my area.

My time to do stuff like this is limited, as I have so little time alone. I had a golden opportunity today, so I took it. I did, however, receive a call from him as I left my office. I wondered if he was tracking my phone. Fortunately, my office is on one of the main streets in town and could easily justify being in the shop next door.

Wow I hope he's not. Can you get your phone checked?

Hopefully, you will get some positive news about the UC when you make your phone calls on Tuesday OP.

If not, there are still ways to make yourself more attractive as a potential tenant such as offering a few months rent up front or getting a guarantor.

Stay strong and focus on moving forward one step at a time. Your husband can be as much of an arsehole as he wants but that doesn’t change the fact that you will be entitled to at least 50% of all the marital assets including pensions.

I have been told today that I don't qualify for social housing because I own property. That's fine, I just don't know why they couldn't have told me that the first two times I spoke to them.

I haven't put in a UC application yet, although I believe I may qualify if I immediately get the house on the market and sell it within six months. I doubt my husband and I will agree anything and have it sold within that time.

I think I need to weather it out for a couple more years. I will be fully qualified and earning at least twice what I earn now, which means I can support myself and DS properly while waiting for everything to be settled. It will also probably mean I can get a mortgage and buy a small house for us.

It's all an absolute minefield but I ultimately have to do what will be best in the long term.
