i think my landlords trying to do me out of my money.....

we put in our calendar months notice...the letter dated the 8th....he said he only recieved it today so we would be vacated by 10th dec...fair enough.....but now he is saying we have to pay til the end of december......i dont see why???? we arent even going to be there and he said himself we would be out by the 10th......he can't make me pay can he? I really don't need this.... his receptionist told me i would have to pay from the 1st to the 10th dec only.....which i would have expected

That is unreal does not make sense!!!!!
Can you go to a advice beuru and ask them?? you should not have to pay..

You have given 1 months notice, as long as it's says 1 month notice (or 4 weeks) in you're contract you are right.

You need to check you're contract smallprint for any clause stating that if you are there for any part a any calendar month you will have to pay for the whole month. Probably not explained v clearly sorry.

If there is any sort of statement like that tell him you will leave the property on the 30th November.

oh no.......CAB have said it looks like he can do that......I don't know what we are going to do i really dont....there is no way we can afford 6 weeks rent on 2 places......... I don't know what to do now.........

tell him to get bent...........

just pay him after xmas. not much he can do once you;ve moved out, not like he can evict you. if you have to pay it, then just move and tell him he can have it later or take it out the deposoit. not really the right thing to do but hey.

Unfortunately, not paying the last month is NOT a good idea. If your contract states that you must give a certain amount of notice and that that notice period must start from the end of the month, (which sounds like the issue here)then if you leave without paying, your landlord can pursue you through the small claims court. It's a fairly straightforward process for him and he sounds like one who will do it. If a judgement is made in his favour and you don't pay up, you will end up with a county court judgement against you.

OK, well he cannot have 2 lots of rent on the place, so, if he has a new tenant by 10th, you should not have to pay from 10th to 31st. Is there anyway you can assist him in finding a new tenant?

If the tenancy agreement provides for the month's notice to run for a calendar month, i.e. from 1st to end of month, then technically you would have to pay for December. However, he should not be able to profit from this and should be agreeable to waiving the balance of that month's rent provided he has already relet the property.
