High Income Child Benefit Charge after Separation

Hi, I'm wondering if anybody can offer some guidance on this subject please? I've done a LOT of online research and got nowhere! My husband & I recently separated (different houses, separate finances, etc) but we are not divorced or "legally separated". When the HICB tax charge came into force we opted to stop receiving CB because my husband earned over the £60k threshold. Following our separation, I have opted to start receiving it again - I earn about £14k part-time. Is there any chance my husband could be presented with a tax bill because of this? I have read lots of things that say no, because it is based on household income, but then I've also read conflicting information that says yes, because we are still legally married and would either need to be divorced, legally separated or separated for 12 months+. Any thoughts?
