Does anyone know about this? One of my friend is selling her house and has been told by her sollicitor's office that there is no covenant of light and air on her house. She was asked if she would like to buy one. She didn't fully understand the explanation given by the person who called her (not a lawyer), who didn't seem to understand it all himself. She'd like to know why she should buy one when there wasn't one when she bought the house. Thanks in advance for any help.

Difficult to know exactly what the situation means but i would warn your friend not to buy anything. It all sounds really wierd sorry to not be of any better help but without knowing the correct wording it is difficult to give advice.

It's something to do with having a right to the light and air coming into your property. so, if someone puts in a planning application to build a 20 foot high wall which blocks the sunlight from your living room, you could object on these grounds. If there is no such covenant, you can't. I think. That's what I understood it meant. Anyway, right or wrong, this has bumped it up again!

Thanks SD, that's what we thought it was but why should she buy one now when there wasn't one when she bought the house, especially as she's moving out soon?

LOL Piglit that's what I thought when she told me about it "No more breathing I'm afraid, you haven't got your covenant of light and air!"
Having said that it all seems very serious but my friend is not about to fork out! Would be nice if someone had heard about that before though and could say how common these things are, and if it matters all that much.
