Fecking ex-landlord.

Taking her to small claims for wrongly keeping a portion of our deposit. Got a copy of her defense in the mail today and the WOMAN IS A LYING SACK OF !

She lies like a rug!

I cannot believe that she can actually sit there and pen such nonsense!

Going to take the letter to a lawyer - all off on hols DRAT! - and see what he/she thinks.

Problem is that it's her word against mine. I have got to go halfway across England to appear before a magistrate at a hearing and it will be all I can do to keep myself from throttling her.

Wonder how much it would cost to send a lawyer in my place???

I am going to try that coz at the best of times I am nervous at having to be a hard-hearted b and having to go in front of a magistrate and keep my cool and sound coherent is going to be impossible. At the moment I am a shaking wreck.

What do you think - I was going to try to get some legal advice from a solicitor and then have them write a defence to send to the court. That might be a cheaper way of getting around it.

Sounds possible or can you consult CAB to see if they would help, perhaps cheaper still ?

At the risk of sounding defeatist, my sister got a judgment against a landlord years ago, but you then have the additional problem/cost of enforcing it and actually getting any cash from them. Unless it is a serious amount of money, I am not sure it is worth it, tbh.

These people are swimming in money. If I do win and they don't cough up, they have a loverly County Court Judgment on their credit rating.

Spoke with a Dad from DS's class today who does something along the lines of law for corporate property and he had a few suggestions - one of which being to attempt a negotiation for a lower amount. I feel like that is handing a subtle victory over to her. It is tempting as it would cut out a huge headache for me in having to tear apart her defence in front of a magistrate.

Getting together with a friend tomorrow a.m. so that we can look all of this over together so that I can somehow hammer out a response to her defence which makes her look not only like the liar she is, but juvenile to boot. The bloke we spoke to today gave us the name of a couple of litigation guys he knows who may be able to rate my chances and point me in the right direction.

Still fuming about this. You know how things can niggle on your mind a bit....this has been rattling around in the old cranium today non-stop.
