I agree that if you offer the asking price and it's not accepted it's extremely irritating, but it hardly makes him a pig. He hasn't accepted your offer and then backed out, he's just refused to accept what you thought was a good offer. The house market has gone nuts around here at the moment, we're about to sell and the estate agent we have had round is desperate to get hold of ours as he sold two in the past week for more than the asking price, and within 7 days. Once I accept an offer there is no way I would back out, even if I got a higher offer, as I feel that would be immoral, BUT if I have a few people interested and I think I can get more than the asking price of course I will hold out for the best deal - doing anything else would be extremely stupid.

No doubt he is trying it on and is treating it as a game (not surprising as you said he does not need to sell the house to move as you stated earlier so he can play around if he so wishes). You have to decide what you do from here. 1) Reiterate your offer and threaten to walk away. 2) Offer less than the £40k asked for and wait and see. 3) Offer the £40k asked for. 4) Walk away anyway.
I know some estate Agents are arseholes but I would discuss the issue with them in some depth they must be aware of what the wanker is up to as they have spoken to him. I know they stand to gain more commission from a higher sale but they will want a quick sale more! Bird in the hand is worth two in the bush and all that malarky.
Lastly if he accepts a revised offer will he take the house off the market? You want to be sure he is committed to selling the house to you.

I would stick to your guns I can't be bothered playing silly games with people like that. Do you think the estate agent could be dogdy and trying to get more commission?

A friend of dh's had accepted an offer on his house which IMO had been massively under valued and put in an offer on a bigger house. The estate agent then advised him to gazump his original buyer because he had another buyer who wanted to pay £80k more than the asking price so he went along with it only then to be told by the people whose house he was buying that they wanted £80k more as well otherwise they were pulling out. So he ended up being worse off because he had to pay more commission and stamp duty. Turns out the estate agent and the vendor were golfing buddies.

Oh sure. That must be nice. You fancie house that backs up to a view over Richmond Park and you just buy it. Just like a nice cozy Sunday shopping trip.

So how does that work then? You get made redundant so you... buy a bigger house....

It works by not being mortgaged to the hilt so we can afford more if we fancy said house

or NOT as the case may be

(actually we can afford it but I don't want to pay it )

he's messing you around. You made an offer in good faith based on what he was asking for his house. You could say to him take our first offer & you'll get the cash or wait and you'll end up having to accept a lower price. To ask 40k more is just ridiculous - unless the house was under valued?

You could try asking your buyers for an extra £40K .

You could offer an extra £10K on condition that he enters into a binding agreement not to sell to anyone else or increase the price for a set period of time. If you are able to exchange within the agreed timespan, you will do so at the agreed price. If not, he is free to increase the price and remarket the property at the end of that period.
