Ebay advice needed!

I have just had a karaoke machine delivered which I was intending to give to DD1 for xmas. It was listed as used but in very good condition however the casing is cracked (may have been damaged in transit) and there is a stain on one of the speakers. There is no way we can give this as an xmas present, have contacted the seller to request refund but just wondered where I stand. I only paid ?6.00 p&p but that was the seller's standard rate and insurance etc was not offered. The player was not very well packed and may have been dropped but that does not account for the stain which in my opinion should have been mentioned in the listing.

your right it should have been mentioned.
sometimes thought you get a bad seller and there isn't that much yoiu can do except avoid them in future

why can't you giev it to her for xmas?? how old is she?

She's 7 and might not notice at first but her friends definitely would, we have paid £42 in total for it and it was to be her main present. DH wants to just give it to her to play with and definitely doesn't want it be part of her xmas presents as it so shoddy but then I'll have to buy something else for xmas and will have wasted £40.

You could ask for a refund, it does sound not entirely nice.

We would just give her it but like her xmas presents to be special I've asked for a refund and am just hoping that the seller is genuine and will refund what I have paid. I'm just a bit disappointed really as this is my first negative experience with e-bay and was looking forward to seeing DDs delight on xmas day. It's also going to cost me about £9 to return it and then will have to bid on another one, serves me right for thinking I had got a bargain.

What method of posting did she use, if it was parcel post, 1st class or 2nd class you can claim up to £32 compensation for damage in transit, but think you would need the receipt/cert of post which she would have been given by the post office. Hope you get a refund though - very annoying when this happens.

hope you dont mind me posting here I havent done this before but have quite a lot of experience on ebay.

First I would wait and see what she/he says if they dont reply or are negative and unwilling to refund you can file a report with e bay, not worth much to be honest, but if you paid via paypal you can also put in a claim there, if you ask for a full refund you will be expected to return the item, there are cheap couriers on e bay who offer next day delivery via DHL (payperdrop_uk) for £5.99 this insure it against loss for up £100 and you get a full tracking number which you need to prove its been returned. Then hopefully you should get your money back from paypal.

Thanks for the advice everyone its really useful to know where I stand, the machine was sent by second class post and was not packed very well, it was in its original box but without any additional packaging. It was also upside down with the address written on the bottom of the package, I know it doesn't make much difference but there was no indication that the item was fragile on the packaging.
I will just have to wait and see what response I get from the seller, it is possible that he/she will be as disappointed as I am with the damage.

Forgot to say feedback for the seller is all positive although only 22 transactions and mostly for buying. I am hoping for a full refund and will definitely use the courier service as suggested. Thanks again for some great advice.

I've recently been having a few problems with some ebay items (clothes) that i ordered.

When i contacted the seller they really couldn't be bothered.

One even told me to re-list it and sell it myself.

I couldn't sell it, it was awful, so i put it into the charity bag.

if you havent heard back from the seller yet I would put in a claim with paypal if you paid that way for item not as described or damaged, that way you may get your money back even if the seller doesnt want to give it to you, if you dont know what to do or need help just give me a shout
