2nd hand clothes shop not paying commission, what shall I do?

A clothes shop took some French outfits and sold them for me on a 60/40 basis. I am now owed £32. I have been asking for this money since the week b4 I went on holiday (beginning of Feb). I have phoned 3 times asking for the money and been met with various excuses no cheque book, couldn't remember amount and the last one was "I've already sent it but I'll send another".

I have no written agreement with this woman and it's really starting to bug me now. My husband suggests I forget about it but what do you guys think? He also suggested I mention that I will get in touch with all the local Essex NCT branches if she doesn't pay up.

I know it's not a lot of money but I'm starting to feel cheated. I'm not very good at confrontations! Advice please. R

In fact, I'm going to name, shame and warn you. The shop is called Kids Connection in Queens Road,Buckhurst Hill.

I'm afraid there's only one thing for it. Go in, all smiles, and ask for the cheque, as if it were the most natural thing in the world. Pretend there is no history of bad attitude on her part. Then, If she doesn't give it to you, remind her that her whole reason for existing is people like you and if your not happy, you'll make sure other people know about it. NCT, local paper etc. For £32 she should soon cough up!

Even if it's not a lot of money, it's the principle of it...they owe you and you have a right to demand payment. It shouldn't need to be a confrontation, but if they want to play it that way then so be it!

I agree with manna, be polite but firm. If she still makes excuses or offers you credit tell her you are not satisfied with that as it was not the original agreement, and flash around any paperwork you have to that effect. I would also try to go in when there are other customers in the shop, as the owner is far less likely to want a "scene" when there are potential shoppers as witnesses! Good luck!

Definitely ask for your money when there are other shoppers there - nobody likes a scene. If she still refuses threaten her with trading standards, the police, the local paper, etc etc. If she is doing this to you she is probably doing it to everybody else and you may find that TS are building a file on her. Don't give up without a fight! (Can you tell I used to be a consumer journalist!!)

Rhiannon, can I ask how long this business has been trading? IME, many shops like this quickly fold up due to lack of profit. Perhaps the owner has realised she's on a losing wicket, is running up debts and doesn't care about her reputation. If this is the case, get your smiley face in there now.

So, Rhiannon, did you ever go back in there and get your money? I think the best way to cause a scene would be to walk in, pick up clothing of your choice to the tune of £32, tell them that it is in settlement of the outstanding debt, and go to walk out. The last thing they would want is a Police presence in their shop!

I havent read all the post yet but I would get the money your owed. Its not a lot like you say but its all about principle. They owe you no matter what and people should not be thinking they can get away with things like that. Who knows how many more people theyve done that to. Tell them if they dont give you your money then youll report this to the newspapers that this shop is taking peoples clothes on consignment and then stealing your share of commission afterwards. They wont want to get a bad business reputation. Hope you get your money.

Well, she did finally pay up after I phoned and asked her if she had some sort of a problem with paying me. She said she'd send "another cheque" - yeah right! Well it did finally arrive and didn't bounce as far as I know. But she won't be seeing me again.
