yawnish ebay question, I bought a playmobil castle off ebay and the photo was the new one...

but when the castle arrived it was the older style one (ie NOT the same as photograph). Also the dragon (which had been listed as an extra item) was broken.

I have emailed the seller twice with no reply.

Would you open a dispute with ebay at this point? - tbh I will keep the castle anyway but I am cross at lack of communication and especially about the dragon as I bidded extra for it.

I probably would, but would be prepared to be turned down - the Ebay term is 'Item Significantly Not as Described' and they may say that the description was accurate enough.
Was it a catalogue pic on an obviously 'Used' item description?

Have you put negative feed-back on that tends to buck them. But if you haven't go what you've paid for then complain. Just check that the advert didn't say photo for illustrative purposes only/product may differ for that's how some people protect themselves. If not then would strongly complain. It is people like this that ruin Ebay. I"ve been lucky so far and had only want complaint and got a refund within a week. Good luck

they had used a catalogue pic to sell a used item (ok fine) but it wasnt even the same blooming thing!

Very politely tell the seller your concerns and give her a time limit, say a few days, to reply to your message and request (ie refund or part refund) and state that if she doesn't respond you will have no option other than to open a dispute and give negative feedback.

A good seller will want to rectify a problem to prevent negative feedback.

Asking the seller for a partial refund seems the best in your circs, as you want to keep what you have and if you've paid by paypal, this is very easy for the seller to do.

If after 10 days you have no response, open a dispute and then e-bay contact the seller with a similar message and this may spur them on to doing something for you.

If it's all settled to your satisfaction after ie you have your refund, you can give positive feedback.

Is this the castle that you didn't really want to bid on, then did by mistake, then were gutted that you'd won?

i'm with emmatom on this one. doesn't really matter whether you might keep the castle, it's not good ebay practice and someone else may fall victim too.

false advertising - the description did not match the item.

emmatom that is excellent advice, i will do that. I think I will give them a week to reply as I have been trying to contact them for a week as it is.
