Think I've been done over on Ebay. ADVICE PLEASE!

Bought dh an Xbox 360 to cover Xmas and his birthday in February - Thought I was being ever so clever!

I paid for it on 18th by 2nd chance offer. The seller contacted me to say the winning bidder was an 'African Conman' and would I like it instead? Excited I said yes and paid via PayPal.
I paid £10 postage and asked when I should expect it. By Thursday he said.

It is still not here and as a result have had to tell dh anyway which I'm really pissed off about as it was meant as a surprise.

Dh last night emailed him asking him where it was and was there a tracking number we could have? No reply.
I have today mailed him explaining £200 is a lot of money to us and I am concerned as it is not here, can he contact me by end of today. I have said I do not mean to cause offence or alarm but I am concerned.
He only had a feedback score of 2 but I thought 'Give the guy a go'. First time I've bought from someone lower than 30. One of his feedback comments was 'Slow to post'.

How long do I wait before I go any further?

Did you pay by Paypal? I believe that offers you some protection. I would be inclined to leave it until Monday and if you get no reply over the weekend mail him again and let him know you are taking it further with e-Bay and Paypal.

Hope he is genuine.

If you paid by paypal, you can get your money back through them, and launch a dispute with ebay, but contact paypal first (ebay charge for the rpivelege).

You could buy xbox 360's all over now, play.com are brilliant and have no post charge....

Hold on are you saying you bought the item in February and are now pursuing it?? You only stand a chance of getting your money back if the purchase was made in the alst 30 days....

1B1B, I wouldn't panic too much yet. It's only a week ago today that you paid. I can understand your worry about not getting email replies though, but maybe the seller has gone away for a couple of days. You can always lodge an 'item not received' complaint via Paypal - it is between you and the seller at first, but you can then escalate it and Paypal will take over if required. If it were me I would lodge the complaint now if the system will let you. HTH

So it's just been a week? It has generally averaged a week to 10 days for me, although some ebayers are much quicker which is nice. It's such a large sum of money that I wouldn't give him longer than 10 days before submitting an "item not received" complaint, unless of course you get an email back before then with some explanation.

No for his birthday next year!!
I did use PayPal but apparently unless his advert had a PP symbol I don't think I'm covered.
I can't see one on there....

I didn't want to set up the 'item not received' yet in case he is genuine and as mentioned he is away, but I'm so worried because of the amount.

How many times do I let him say it's on it's way?
If he says it is over the weekend and then a week later it's still not here, then go further?

Yes, if he says it has been shipped then I think around a week for delivery is sufficient. With something that expensive they usually ship with confirmation numbers (at least here in the US).

You can just cancel an 'item not received' complaint if and when the item arrives btw. I'm sure any reasonable seller would appreciate that you are concerned because it is such a large amount of money, and you have had no response to your emails. When the item arrives, you can cancel your complaint without it affecting the seller (or yourself) in any way ie: strikes against your account by eBay.

It has to be a certain amount of time after paying before you can start an 'Item not recieved' complaint with Ebay so just keep emailing till then. You can also request contact details and phone him? All sellers have to give correct contact details and you have a right to see them if you are buying from him.

I did put in my last email that I am just concerned at getting no reply due to the items value and a genuine seller would see my point of view.

IIRC, you can lodge an 'item not received' complaint on the 8th day after payment.

Excellent. I think I'll wait till this evening to give him a chance to get back from work or whatever then do it last thing before I go to bed.
Then I've given him the whole day to reply as i said I would in my email.

TBH dh & I NEVER buy OR sell anything on ebay for that price.

We have had a bad experience where dh had an xbox360 spare (I had got one as a surprise and he had also managed to get one iywkim)
DH advertised it and it was sold. I arranged for it to be courier to the "woman" as payment had been received via paypal. Safe..or so we thought..Weeks later dh was contacted by ebay and paypal advising of the fact that this item was paid for via a stolen card.
This woman never existed and that this amount was being reclaimed from us.. DH disputed it and was told it would be resolved within 3 months. We haven't heard a thing. All paypal say is it's parts of their terms and conditions and that we are liable. So because some used a stolen credit card we are now £300/£400 down and minus the game.

Ebay have contact dh trying to claim sellers fee's on this item. He is refussing to pay and has told them to take him to court. Why should he pay for an item he is now without..??
Needless to say dh has now cancelled his account and the most I pay for item is around £20.

IMHO neither paypal OR ebay are able to protect you.

I know it's sightly differnt to your situation BUT I wouldn't out yur hopes on getting a happy ending..thats unless of course the guy is a slow poster...

saw consultant today about being REALLY uncomfortable and felt like a prat- they fobbed me off saying its normal to be really uncomfortable in subsequent pregs! pants!

i think the bump will land soon though. i keep getting very strange feelings and cant rest, like when a dog mills around trying to find a safe place to birth- lol!

we had a problem with a ebay seller they said they posted the stuff off but we never received it so i put up an appeal to ebay for item not received but we had to wait 10days then after the days we put the appeal in it went through paypal as thats how we paid for it,

then paypal got in touch with the bloke and then he sent another one through the post to us as he had to as paypal was on his back, i cant imagine how up set you are i was stressing and it was only for £10!! good luck with it

Dp's friend got ripped off on ebay by a scammer in canada.
He sold his laptop for whatever amount (over £300 I think) and buyer had the cheek to ask him to wrap it up nicely before putting it in proper packaging as he was forwarding it straight on as a bday pressie to someone.

turns out the card used was stolen and dp's friend had already sent the laptop by the time this was discovered.

Visions of you trying to find the dogs bed lol..!!! Bless you, not long now. Whens your due date.? Luckily i'm not in that position yet but not long..the weeks seem to be flying by..!!

Looks like tiredemma knows of a similar experience to ours...

we got fleeced on ebay for £130, the bloke did this to 4 others, then un-registered so nobody could get hold of him, ebay were not much help. never got the £130 back.be careful!!!

shhh- u and i seem to have a few things in common but they are all pants things!!

i remember when i was little the dog was about to drop and she was roaming/milling about, whining till she decided on behind the sofa!
i have two dogs, their baskets are huge.... i could probably fit in....

this ebay thing, ive got an awful feeling ive been done.
dh wants to wait till the morning to see if it comes. if it does i will be over moon. the excitement may bring labour on! dont want to loose money as i have also had to buy another cot this month!

i never buy from anyone that doesnt have at least 10 feedback ratings, he could just be a slow poster, its only a day late, leave it until tuesday and then file an item not received with ebay.
