I would get all the details to contact Parcle Force, then send them to her and ask her to hassle them and say that you will do the same - implying that you will work together to sort thm out - and also implying that you are not going to give her the money back easily. Also contact paypal to explaint eh situation ask their advice etc and tell her you have done this.

Hopefully, if she is trying it on she will decide taht it is too muchwork to have to paly along etc still not knowing that she will get her money at the end of it all. If she isn;t then you are doing all the right things so no-one can hold that against you IYSWIM!

SpaceCadet · 17/08/2006 23:18

thanks securmummy-you cant say fairer than that really can you?

update-buyer rang this morning, she was very nice and said she hadnt received it but when she realised that i had definitely posted it, she said look dont worry, its not your fault.
i phoned her local depot and they said, they delivered it 2 doors away.
phoned the buyer back and she went round to neighbours who denied all knowledge of the package! so the upshot is, shes phoned her husband who is coming home from work to go round there, and if no joy, they are phoning the police, the only thing that worries her, is that she thinks they signed with a false name.

bump, would now appreciate some further advice as parcel force say they are not liable

OP posts:
crunchie · 18/08/2006 12:16

I don't understand HOW parcelforce can claim they are not liable. Basically they are admitting they delivered it to the wrong address - OK a neighbour. You paid for it to be delivered to a particular address, they should have done that. I would go bck to parcelforce and rant A LOT!! They have compensation claim forms on their website, if items are lost/damaged they are liable. THAT is what you pay for. I would phone again and get VERY TOUGH

crunchie · 18/08/2006 12:22

Reading parcelforces T&C it looks like they forgot one vital thing - to put a card through to say where the item was delivered to.

From their website:
2.1
Parcelforce Worldwide undertakes to deliver to an address specified in the despatch documentation, not to a specific person.

2.2
If there is no-one present at the address then:

2.2.1
the Customer acknowledges and agrees that Parcelforce Worldwide may at its discretion attempt to deliver the Consignment to a neighbouring address within a reasonable distance of the delivery address; and

2.2.2
if this occurs, a Customer Contact Card shall be left at the specified address; and

2.2.3
the Customer agrees that such delivery shall constitute delivery to the address specified as the delivery address in the despatch documentation.

2.3
Parcelforce Worldwide does not undertake to intercept a Consignment in transit before delivery has been attempted.

2.4
Parcelforce Worldwide shall not be liable in respect of any Consignment delivered to the delivery address or other address specified by the addressee, where any person misrepresents his authority to receive a Consignment on the addressee?s or Customer?s behalf, or where Parcelforce Worldwide is delivering it in accordance with instructions from, or purporting to be from the addressee.

2.5
On delivery of a Consignment, Parcelforce Worldwide will request the person who accepts delivery (not necessarily the addressee in person) to sign an acknowledgement receipt, which may include signature by electronic means. Copies of such receipt shall be available for a period of six months from the date of delivery, subject to payment of the charge as then published.

Looking at this point 2.2.1 says they can deliver to a neighbour, but 2.2.2 says they have to leave a card. 2.2.3 means you have to accept this is proof of delvery!! That stinks IMHO. However Parcelforce's T&C state they have to put a card through the original address door, THEY DIDN'T DO THIS. I think you have a claim.

They also don't make it clear, unless you search through their T&C that delivery to a neighbour is considered delivery!! That's shocking!!

CountTo10 · 18/08/2006 12:31

At least the buyer is starting to be a bit more reasonable. Crunchie's defo got it right - don't let it go, in these situations sometimes the more noise you make the further you get. They rely on people to swallow their crap and walk away. What a bunch of a

SpaceCadet · 18/08/2006 13:13

im not letting it go dont worry, hopefully the slip up in not putting a card through the door was a vital mistake in my favour..i feel really sorry for my buyer, she wanted the buggy for her holiday next week.

OP posts:
UrsulatheSeawitch · 18/08/2006 13:19

Hm - proving they didn't leave a card will be impossible, won't it

Enid · 18/08/2006 13:25

dont expect any help from parcelforce

my parcel was in a van that got STOLEN last xmas despite parcelforce insisting that it WAS delivered for 3 weeks before they told me about the van.

STILL pursuing them for compensation!

SpaceCadet · 18/08/2006 13:25

yes i had thought that too..its just not on, they might as well just hsand your parcel to anyone in the street.

OP posts:
SpaceCadet · 18/08/2006 13:26

OP posts:
Enid · 18/08/2006 13:29
