I don't know if you remember when I posted on that ebay thread about my winning an auction but over 2 weeks on still not recieving the goods after paying.

Well I've since emailed the seller again asking where the blankets are, and after a wait of a few days they told me I would receive the blankets this week. Well this week is over and I'm still blanket less. This is the second or third time they've told me the blankets will be here by the end of the week and tbh, I'm getting sick of waiting for them now. The Auction ended May 15th, and I paid on May 15th so imo the seller is taking the piss.

What do you suggest my course of action should be now?

FD.

Oh dear I am sorry to hear this. Well, in the grand scheme of things it is still early days, but as you have been told several times that they will appear and they haven't, I would definitely report them as a non-performing seller now. I think that may hopefully do the trick. I will find some links for you.

\link{http://pages.ebay.co.uk/help/tp/inr-snad-process.html\Here you go}, start here and select "Open an Item not received or significantly not as described dispute". I can't get the relevant page up for you as you would then be logged in as me :)

I would start the process now, it is not irrevocable and will probably nudge your seller into sending the goods. They don't sound fraudulent as such, just crap. If they don't send them, you can easily escalate the dispute by making a claim, and may be able to receive your money back from eBay (do you mind telling me how you paid and how much roughly they cost?)

I am sorro you've had a bad experience. People often get put off eBay when things like this happen, but I have had hundreds of transactions and only one or two have gone really wrong - bizarrely, the one time when I had to actually make a claim and try to get my money back, I was not successful, but months later the seller's relatives got in touch and refunded my money - there had been a huge family crisis and everything had gone to pot for a while Shock

I paid £15 in total so its not a huge amount of money, but its money I can't afford write off.

Auction is here : cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=110000249774&rd=1&sspagename=STRK%3AMEWA%3AIT&rd=1

No don't write it off, I was just trying to remember how the compensation thing worked. I think if it's under £25 you are not covered unless eBay can actually recover the money from the seller's Paypal account - which is unlikely IMO :(

However I think just proceeding slowly along the Non Performing Seller route and giving them time to get their crap together and send the stuff, may well work.

I'll have a good look at the auction and the seller and get back to you, but open the dispute now if you have time, the one on the link I posted.

You might still get them - if you look at their feedback lots of people have complained about the length of time to deliver! But also some never received them and the seller doesn't seem too bothered - no follow up to feedback.

FrannyandZooey · 10/06/2006 09:48

Ok I must say the the seller's feedback was awful even when you bid on the auction. It's a good idea to look into people's feedback before you bid - I wouldn't have touched this person with a bargepole. even when people have left positive there are a lot of comments about slow postage and item not as expected. This is a shoddy seller. 98.4% positive feedback sounds ok, but is actually a sign that there are a LOT of problems happening, especially with a high volume Power seller like this. One to avoid.

However having had a good look at all the feedback, I think you will get your goods if you are patient and don't do anything drastic. Open the dispute, but then give the seller a good amount of time to send the goods. The feedback states that it can take 3, 4 or even 5 weeks for the goods to arrive, but that they do arrive. The few people who have left feedback saying the goods have not arrived have done so much too quickly. Some state they have only waited 3 weeks, while others say they are in the process of opening a dispute, but not that the dispute is closed.

Don't leave feedback until the whole thing is over and you have either got your goods, your money back, or have claimed through eBay and unfortunately failed to get your money back because there are no funds in the seller's Paypal account. You can't leave an accurate summary of what has happened until the transaction is over - and many of those feedbacks have been left before the transaction is over.

Also, feedback is your final tool for negotiation with the seller. If you are still waiting for your goods and you leave negative feedback - the seller now has nothing further to lose, and no incentive to send your goods at all. You have effectively closed the transaction. Stay calm, open the dispute, give it another 2 or 3 weeks and see what happens. If necessary you can then escalate the dispute and make a claim. I think you will receive your blankets before then. But next time don't give such rotten sellers your custom!

I placed a dispute asking for a refund from the seller last saturday. They have not replied to me as of yet. What do you suggest I do now? Wait a bit longer? Or what?

Thanks

You need to wait 10 days until you can escalate your dispute to a claim. I would do it as soon after 10 days as possible. If the seller doesn't respond, it will be easy in a way - eBay automatically rule in your favour. The buyer really should be niggled into responding - but they are listing and selling hundreds of items and I would guess that the volume of sales and emails is more than they can handle.

I don't think you are going to have any luck if the dispute is closed - I don't think eBay will refund on items of £15 or under, but hopefully the seller will see sense. If they have a number of claims against them they will be suspended, that should put them off a bit.

I do hope you hear something soon.
