Baby Mobile Broke hurting baby. What do I do now?

I bought a new Musical Mobile from a very well-known babyshop & this is what happened.
6 months after purchase, I was winding up the musical mechanism while dd was in the cot & the mobile broke. The arms holding the animals and the music box fell directly onto DD's face. One of the arms landed on his face with the full weight of the music box attached to it, digging into the skin just below dd's eye. DD screamed & bled profusely from a deep cut to the skin under the eye & had a bruise just underneath the cut. It was sheer providence that it didn’t hit dd directly in the eye whereupon DD could have been blinded.
I discovered that the head of the mobile arm that suspends the unit from the cot side had broken off, causing the arms cross-frame structure, animals and music box to fall simultaneously on to the baby’s face. I examined the mobile to see what could have caused a deep stab-like cut to the skin and discovered the mouldings to the arms of the mobile; from where the animals are suspended have a rounded top and then a thinner lip. The edge to the lip is very sharp to the touch.
I did get photgraphs of the injury to DD. I sent them a couple to show the injury.
I'll get to my question to you all -
I have written to the company who have requested today that I return the mobile to them for examination prior to them doing anything.
Should I send them the mobile? (I don't want them to lose it as it's my evidence)
Any other suggestions?
Any experts in this type of thing?

What a terrible thing to happen! You could always contact Citizen's Advice or join Which? - call someone there and ask what you should do.

yes you should send them the mobile .. take photographs of it first .. they have a right to inspect it I believe

Contact your council's Trading Standards Department for advice on whether you should return the mobile at this point. I can understand why they want to see thr product, one would hope it is because they are very concerned about what has happened.
What an awful scare for you. Thank goodness she got off as comparatively lightly as she did.

oh poor little mite. Is it one of these mobiles you put together from bits? If so I think if it were me I may have to take it on the chin. Now if the mobile had snapped due to some weakness in the fabric that it is made with then I would squeal very loud.

Agree take the photos and send it recorded delivery if you can. They'll need to put it through their quiality control to see if it is faulty, not manufactured to agreed specifications or a design fault. Hope your dd is ok now.

I had a similar experience with my ds being injured by a toilet seat insert (it broke as he sat on it and his bottom was pierced by a screw). It was bought from the obvious babyshop - I took it back and spoke to the manager of the branch - she took it off me, gave me a £10 refund and took my name and address saying that they had to 'examine it at headquarters'.
That was the last I heard - and that was 3 years ago!
i was very annoyed that I didn't at least get a letter saying that they had checked all the other stock for safety!
If it's the same company then I would advice you to hang onto the mobile.

I also had to get trading standards involved in another dispute with this babyshop, due to illegalities with some in-store promotions - they ignored letters from trading standards as well.

You need trading standards as this falls under unsafe products (criminal law) rather than consumer, and they are the people who are responsible for enforcing the relevant legislation. Personally I would try and make an appointment to see someone there and take the mobile with you - they will advise you as to whether or not you should get rid of your only piece of evidence! If you do have to send it off they will have had sight of it to back you up later if necessary. Good luck.

Interesting to read your comments, especially bluebear.
I re-read the 'shop' letter this afternoon when dd was asleep and I wasn't distracted (yes, all too familiar) to find it said 'please find enclosed £20 gift voucher' to spend on dd.....only there wasn't one in the letter. Of course I wouldn't be able to prove I haven't got it as it says it on the letter that I have!
That's why I'm worried about sending the mobile off into the great big vacuum of the 'well known shop' Customer Services....

If any more of you had similar experiences with the said shop, it's worth knowing (cause they aren't all that cheap either!)

Don't want to throw the cat amongst the pidgeons here, but most mobiles are advised 0-5mths only, as babies start really grabbing and pulling at them after that.....was just thinking as you said 6mths on, that the shop/manufacturer might use this point....

If it is the mobile I think it is I believe that it says you can use it until baby is sitting unaided although I could be wrong.

I personally would contact the customer care ppl asap and advise that there was no gift voucher in the letter and that you are unhappy about being sent what is obviously tweaked letter, as k for all your comments to be noted on you complaint file (as they should have one set up) and advise them that you are going to be contacting trading standards before you return anything as you do not feel they have taken the complaint seriously enough.

Yes, that's what I remember seeing on the packaging flutterbee. DD is only just sitting now unaided and the thing broke Easter time.

Will see what they say tomorrow.
