If it was clear it was an accident, no other children were involved and the correct procedure was followed after the accident, would you take legal action?

did he have any problems afterwards btw? i think we should maybe have a Hidden Hazards thread - a friend's 5 yr old dd was in A&E last week after squirting herself in the eye with one of those liquitab things you wash clothes with.

I was in school with a kid who had to be taken to A and E to have a tooth removed from inside his ear....it had fallen out and the silly bugger pushed it into his ear (we were in secondary btw). The next week he had to go to a and e because he had shoved a tiny rubber from the end of a pencil up his nose and couldn';t get it out. You can't legeslate for the stupidity of some kids!

Tee hee. You should be proud of not knowing, I wish I didn't. Mind you, my knowledge of them largely stems from ds's Goodies DVD.

No, no lasting problems thank you- massive scar, but it's mainly hidden under his arm. No nerve damage thank goodness

No, wouldnt sue. Think things are getting totally out of hand with all this suing, children and accidents go together. As long as the correct procedure was in place and as long as the equipment was safe. If we all sue, kids will be banned from doing everything......

I would but only if there was a fault with the equipment or the safety practices etc of the school and they did not take these things seriously and take steps to correct them. Otherwise, no. Accidents do happen, generally through the "stupidity" of the child. (Not really stupidity but can't think of another word!)

accidents happen. but if the equipment was faulty then maybe i would. i have just won a clain against the l;orry driver who took out the ftont of my car last year but he admitted full liability as he cut the corner at speed. it was an accident but one that could'vge been avoided if he drpve sensibly.

Sorry Crunchie but I have to stick up for H&S ! H&S (or the HSE to be more precise) doesn't say you can't carry a heavy box of magazines at work but it does give you guidelines on how to carry them safely so as to reduce the liklihood of you being injured.

A lot of H&S stuff is mis interpreted by the media which results in misleading stories eg conker trees being cut down in case a conker falls on someone to use a previous example.

With regard to playground supervision, I would say if more than one child has been injured - then a risk assessment should highlight that more supervision is needed.

H&S bods are not all killjoys you know !

Of course I wouldn't sue - I'd thrash the living daylights out of him for being so careless and mis-using the equipment!

Sorry whizz I wasn't having a go at you, it is just my feelng that there is no personal responsibility these days and it is my pet annoyance ATM

I am all for H&S where needed and I think that the bad name has come from the culture that we live in, not your job. It is crazy that a mother feels she has the right to sue a school when her children were being plain daft (see other thread too where a mum wants to sue, simply becasue SHE wasn't supervising her child!) It p's me off

Yes I know. I'm all for personal responsibility to but I have to stick up for my profession - even though it doesn't stick up for me very often ! H&S is just common sense after all (but some people have less than others !)

Well, just to let you knw, following on from ds1 breaking his arm in March 2004 and again in January 2005, he has now broken his nose in school (today). Shall I sue?

Trouble is Zippi, your ds sounds like a sporty boy and quite likely therefore to get into these scrapes whereas my son is a complete wimp. How does it keep happening to him?

Incidentally, what was done about your ds's broken nose? I rang the GP and was told to take him to hospital (40 mins drive away). But 5 mins into my hospital visit (yes they were quick) I was told to take him home and an ENT appt would be arranged for next week. Apparently the GP could have organised that! But it sounds like they won't do anything for his nose anyway. What happened to your ds?

that's right he went to A&E with someone from school and they waited ages, I think he was seen eventually (can't remember exactly) but nothing was done, but it was a relatively unnoticeable break

Yes weekly, though half the intervening weekends seem to involve going to other places than home!

He was taken to the hospital by a community volunteer so was not impressed at waiting with slightly dotty senior citizen for ages!
