Retail brand refusing to refund me money for a shoddy product

I bought a toy from a well known retail brand that I thought would be fun and exciting to play around with in the house but when I put in the batteries and switched it on, it started to die out only after an hour.

I then used another set of batteries to see if that was the problem but the toy was still dead.

When I went to the store to return the item as faulty they said because I opened the packaging and used the product that it wasn't considered as a refundable good.

I played with the toy like any other person would and it was working great for a long period.

I just think too many companies are producing shoddy goods and blame the customer for excessive use Angry

Goods should be of merchantable quality and fit for purpose. If it breaks after an hour it doesn't seem that it was either. The fact that the packaging has been opened has nothing to do with it. How can you know if something isn't working if don't open the packet - they are daft to say otherwise.

Did you have the receipt? It would have been useful if you did as it would prove that you hadn't had it very long and therefore it wasn't a case of overuse. If not, then a credit card or bank statement is suitable proof of purchase too. If you took a long time to take it back it could make it more difficult to prove that you didn't use the toy excessively.

I would ask to speak to a manager as they have a statutory duty to at least offer to repair the toy although a replacement or a refund would be more appropriate unless it was a large and expensive thing. Most toys aren't worth repairing I would have thought.

So you.bought something, it didn't work after a bit, you changed the batteries,it still didn't work then the shop wouldn't take it back. Let me guess- you are the only person in the UK who doesn't know about the sale of goods act, OR because it's late you're going to tell us in a minute that it's some sort of sex toy.
