Do they charge a penalty if they have over paid you?

I was paid an extra payment last year - they told me they were going to take it back automatically and they have done. BUT as it was their fault I have appealed and am waiting for a response. So I would phone them and ask for an the correct form.

Yes lots of people here have been asked to pay back - me included .

Not they won't charge a penalty if it there mistake. They do say they will charge a penalty if you don't send back your assessment form in time.

They over paid me, so then stopped all payments for two years until it was paid back. I wrote to appeal and a year later they replied saying i had won the appeal and they wouldn't take anymore money back from me. If you ask me that was a deliberate delay so that they at least got a years worth from me.

What if I dont send the assessment form back and just phone them up with the p60 details. The form was misleading and I thought they were back dating the payments to 2003/2004 as those were the details they asked for. Anyway I am really stressed now as we are waitng for the P60 to get here in the post and I only have until the 30th of Sept to get it in. Thaks for the responce Albosmum and Hattie

I have never sent in forms, only the very first one. I do it all over the phone witjout any problems. You should have had the p60 ages ago though how come its taken so long?

Anyway as long as it arrives soon you can phone them with the details

i know lots of people, myself included, that have been overpaid. what they seem to do with most people is stop payments, and deduct what you owe back. you'll find that it stops for a while, then starts up again. ours stopped for 2 years and has just begun again because we've had another child. my sil was overpaid to the tune of about 6k!!, they had her income down as nil, but she is a teacher. their credit stopped, they haven't been asked to re-pay it but have just been told it will be about 10 years before they are due anything again, they've never paid a penalty.
