I have a solicitors letter saying my fees are included, now they say I should pay. Opinions please.

OK, we move house on Monday.

We got a special deal with our estate agents when selling our house. Their fee is 1.75% including conveyancing. The estate agent at the time said she thought that only included conveyancing on our sale, but the solicitor would write to confirm this.

Anyway, the letter arrived saying that conveyancing on our sale and purchase was included in this fee. Great.

Just had a call from our soilcitor saying that this was an error, and we do need to pay for convayancing on our purchase. The guy I spoke to was very apologetic and has gone off to speak to a director to see what to do next.

What do you reckon? They are solicitors FGS and this is their mistake, and I have it in wirinting saying nill to pay.

Should I stand my ground or cough up?

Ask to speak to the managing partner or senior partner to discuss this futher. It's their error and as such they ought to stand buy that.

I would have assumed the fee covered the sale only since that is what the fee was for - the sale of your property. However, you have a letter stating that it's for both so I would stand my ground for as long as possible but be prepared to pay if it gets nasty - is it likely to hold up the sale/purchase??

I've just asked if it's going to affect our completion on Monday and they said not. He is calling me back tomorrow so I'll see what they say....
