Do I have to pay for a day when nursery was closed?

We pay a month in advance for our nursery fees, and knew from day 1 that nursery closes between Xmas day and first Monday in January. We don't have to pay for any time nursey is closed.

DD's nursery is on the grounds of a local secondary school, and most of the parents work on-site as teachers or school staff. Therefore, during school holidays most of the children do not attend and nursery is very quiet.

Just before the school broke up for the Christmas holidays we were asked whether we'd be using the nursery on xmas eve, but that due to the school being closed and no hot meals available it would be half day only. On that basis I said I'd keep her home, as we work from home anyway so no point me starting work only to stop at lunch time.

A day or two later we were told that due to poor demand the nursery would be remaining closed on Xmas eve.

Am I right to think that we shouldn't be charged for Xmas eve, due to no staff being present?

We took that day off of January's bill as we assumed that as they were closed, we didn't have to pay. Nursery are saying that we have to pay it.

We will of course pay. I don't want to fall out with them over less than £50, but I really can't see why we should have to pay for a service that was not available to be used. Who is right?

you were asked if you would be using it and you said no which is fair enough

it seems odd that they are then asking for you to pay for it when they had no staff in - were they definitely closed?

If they were closed then you shouldn't pay. They were not available to work.

Not sure what would happen. Our nursery charges even if closed on bank holidays. One of the reasons I didn't choose a Monday as one of my two days a week to send my DS to nursery.

this happened to me. I was given "choice" of whether to send ds2 but was swithering. I then asked what was happening and the manager said they hadn't rostered for him as I had apparently said he wasn't coming! didn't want to make a fuss but on asking for refund got short shrift and only reimbursed for days nursery actually was closed.

but even if they had no staff in they would still have to pay their staff, so you were given the choice and you said no, I would still expect you would have to pay
