Help please! Is this sufficient grounds to end our contract?

Hi everyone, my one-year-old had his settling in week at his new nursery this week. The attending hours were staggered that increased every day, up to the point where he attended from 10:30 am to 4 pm on Friday.

His nappy was changed at 8 am at home by me before I dropped him in at 10:30 (he slept from 9:30-10:30 on the walk there, so I didn’t change it just before taking him in unfortunately…) , and he wasn’t changed at all whilst in nursery. They put a note on the app to say that he was checked at midday and was dry. I’m not sure how this was physically possible as he had had 4 ounces of milk and half a cup of water at breakfast… plus whatever water and 5 ounces of milk at nursery. He wasn’t checked or changed again.

My contract states that it starts from accepting the place which was several months ago, so I am within contract and have a two month notice period. I’m really unhappy with this and also unhappy about some other elements within the nursery (mainly and lack of interaction with the children from staff). Do you think the nappy issue is sufficient grounds for me to pull him out and not have to pay my two months notice period?

Side note. They have had some complaints with the baby room very recently where ofsted had to investigate.

No, I don't think that will be enough unfortunately.

I don't think that will be enough, but I'd still pull him out.

I don't think you could just pull them out after the nappy issue and expect to have the notice period waived unless you have had a discussion/meeting with the nursery staff where you have raised your concerns and given them the opportunity to respond.

No that won’t be enough on its own but presuming you’re certain about the nappy and it’s not just they forgot to update the app e.g. he’s your brand not nursery’s at pick up and soaked through then I’d ask for a meeting with the manager to discuss that and the other issues. Hopefully they’ll be able to alleviate your concerns, or if not then you might be able to persuade them to release you from your contract early.

This sounds like a minor issue of the kind that you will run into with any type of childcare - bring it up with the nursery and give them a chance to rectify.

Say to them that even if it’s dry I would like fresh nappy at every change.
