Fees and leaving a nursery

Hi all. So I took my son out of his nursery place this month. He was 3 in July. So had the free funding from September. He wasn’t happy at his nursery so I sent the nursery an email saying I was taking him out I was told I needed to give notice until December but my son was refusing to go and I got him a placement at another nursery where he is so much happier. I then had calls saying i owed over a thousand pounds in nursery fees. How can this be possible when he is 3 and gets the free funding as all 3 year olds do ? I am so confused.

See how they respond. They may say it's in their policy booklet which they gave a copy/showed you.
Ask for evidence that you received the information and be clear you were not aware. Do everything by email so it's a paper trail.

Based on what you have said you haven't agreed to notice and given that you do not pay them directly I can not see that they can request the money from you. I would email that you were not made aware of a notice period. You did not agree to a notice period and you will not be paying additional costs as your childcare is funded through the local authority.

OP has been paying to date. The DS only turned 3 in July and his free hours were due to start in September

If you've never signed a contract or been given any terms and conditions from them with a notice period in it then they won't be able to enforce it.

I'd email telling them you have never seen or agreed to any notice period and therefore will not be paying. If they have proof that you have been given a contract/t&cs then they can send it to you.

You must have signed something when your child first started at age 2?
There is no way you didn’t sign something
When my DC went to private nursery there were lots of forms plus we got a paper handbook and contracts.
Multiple documents to sign , consent etc.
If you cannot find your copy in the house then ask the nursery to email it to you.
Legally they have to retain all paperwork in a file.
Also it seems a bit harsh of your husband to just say “ we are not paying “.
Business contracts do not work like that.
