Fixed term nursery contract HELP / Legal help

My Little one has joint a privately ran nursery setting at a school (3 and 4 year olds only) and after 2 months we don't think it the right place for them, mainly we don't think the school attached is right for them for next year and they haven't been very settled.

I went to look at the nursery terms and conditions recently for the notice period and found I had ‘signed’ (online tick box) a fix term contract form sept 21-Aug 22 without a notice period. There is no actual contract just the terms and conditions and it does clear states ‘fixed term’ but when I applied I red the following information from the handbook emailed at the same time

‘If within the first six weeks you feel that your child hasn’t settled then you won’t have to give notice.’

I assumed from the mention of notice there would be a notice period post 6 weeks. I feel really stupid not getting more information but we couldn't even look around the nursery due to covid restrictions and I just wanted to a get the place.

We have tired to ask if nursery will fill the place with another child but they have said no and said she has to stay or if we take her out we will be liable for the full payment till Aug 2022. There even mention of debt collection agency in the terms and conditions...

Has anyone come across anything like this? I just didn't know when I signed it wouldn't be right for us or our child and situations change especially in the last 18 months and now feel trapped.

Did it only become aparant after the 6 weeks that it wouldn't be suitable? Ie did something change after those 6 weeks?

Thank you for replying. Yes only after 6 weeks. My little one hasnt wanted to go which I put down to starting a new place so I didn't consider it wasn't the right place until after 6 week when she still didn't want to go. we weren't been able to visit Nursery or the school before start of September due to Covid restrictions either. Nothing change as such we just don't feel like it's right place for her. I understand that's isn't the nursery fault but the contract is so tight I have no option to keep her there as I can't afford to remove her and pay for two nurseries. They say she happy when she there but at home she saying she doesn't want to go still.

I think legally you're stuck to be honest.
