Can they really do that?

Hi, I just wanted so opinions please, I found a nursery for my baby daughter, paid a deposit, but when she went for settling sessions, she didn't settle and I got called to collect her, (there were also several issues which I wasn't happy with) therefore I have decided I can't start her as it isn't the right environment for her.

Bearing in mind she hasn't started yet, they are saying I will still have to pay one months fees. I understand losing deposit but not paying for a month of care we won't be receiving because it isn't in the interest of my child's well being!

I also know there is s waiting list so they will fill the spot quickly.

Anyone ease experienced this or have any opinions on this?

Was this not clear in the contract?

Was that condition in the contract? If they manage to mitigate the loss by filling the place they shouldn't be profiting from that so I would mention that in discussion with them and you may be able to reach a compromise.

That said, the time to decide if the nursery was suitable was prior to entering a contract. If the issues you have experienced we're not apparent earlier or could not reasonably have been known, then you could argue breach of contract on their part.

Need more detail to be able to say more.

What does that actually mean? Did you decide you didn't like the nursery after all? Or did you witness or experience an incident so severe as to have breached the contract by the nursery?

I have not got a copy of the contract, thank you all for advice though I understand they probably are in the right
