Jumped the gun... will I now need to pay?

In the stress of trying to find a nursery for my DD when I go back in March, I signed up with a nursery that I felt comfortable with when I visited. When I dropped by unaccounced to drop off the deposit money (£30) I wasn't exactly comfortable with what I saw.
Anyhoo, I met with a Childminder last night, and immediately liked her a whole lot more than the nursery. I've now signed up with the childminder, and so want to get out of the nursery.
My DH thinks that we'll only have to lose the deposit money at the nursery as my DD hasn't even attended there, and wasn't due to go for five weeks. I think the nursery is going to try to get some money out of us as the contract says "four weeks notice / four weeks pay in absence of notice". DH thinks that as she has not attended, it wont matter.

Anybody know whether the nursery is going to try to make me pay, and where I stand on this? I think DH is going to say we're moving out of the area, but thought I'd check before he rang.

if you give them notice NOW then that will expire before you are due to start

Give them notice now, and that is 4 weeks notice. You will lose your deposit I imagine though.

I'm not too fussed about the deposit, we expected to lose this. DH is going to phone them today to give notice. I just didn't want them to try to get some money out of us.

They may well ask for notice in writing; many do. So I would get a letter ready too to drop off there asap, or to post today. You need to make sure that they receive the letter to still allow for the 4 weeks notice.
