I am so stressed - Nursery is really getting to me!

I am at college at the moment so my nursery fees are paid by them but when i first started we were told it would take up to 4 weeks for the pay claim to be sorted out, which is standard. My nursery said that they couldnt wait 4 weeks so we would have to pay them weekly until it was sorted and then they would give us the money back. Fair enough, this totalled about 500 pound which we borrowed off the mil.

Once the pay claims went through the nursery was back paid for those four weeks. I expected my 500 pound back. But no - they said they were keeping it incase the pay claims never went through on time etc. We agreed that they would have that to fall back on if the finance people every mispayed or anything.

This was over a year ago. These last few months i have been really poorly. So much so that I have had to defer college for a year as I am missing to much time. The college have paid up until 23rd December (Tomorrow) So I informed the nursery that this would be there last day (2 boys)

Today I rang the nursery and asked that they have the cheque for monies owed ready for me tomorrow - as I have to pay back mil. They said No, I cant have it back as they are using it to pay for 4 weeks notice on the boys leaving. So I said that if there are going to be extra weeks paid for then the boys will be there! and they would not be leaving until the money has run out.

Are they allowed to just keep the money? How am I going to pay Mil? What should I say to them tomorrow?

We have to give at least 4 week's notice at nursery too, or pay the 4 week's worth of fees if we took DD out without the notice period.

It gives the nursery time to find someone to take their place. Otherwise the nursery would be out of pocket.

I do agree that the four weeks notice is fair but they are disputing the amount of money that they have of ours (shes just phoned back)

She says they have 216 pound - which is equal to 4 days each at nursery for the boys

We say she has double that. We paid for 4 weeks. She has halved the money. Maybe she has got things mixed up or maybe she just wants to keep the money (and the intrest its earned her!)

I havent offically deferred college yet ie - the college dont know as they have broken up for christmas and i havent told them yet.

You must have a reciept or cheque stub, or some evidence of how much you paid somewhere?

To be honest they were probably not strictly in a position not to repay your money earlier on, why didn't you insist? Do they usually ask for a deposit?

Wish I knew how to advise, can you talk to the CAB.....?

In that case don't defer until after xmas and keep getting your fees paid. You might find you can catch up in that time?
