How to break a nursery contract without notice?

My DD4 has started a new nursery in Sep when i went back to work. She attends a council run nursery mon, tues, wed (where she receives her nursery grant and has been attending since Jan and goes to a private nursery thurs and fri since Sep.

Thing is she HATES the private nursery and gets really upset when its time to go. She says the teacher doesnt like her and when i asked why she said she told me so.
She is not a wimpy girl and has been to a different private nursery when she was two and she loved it but i cant get her back in it.

So now im thinking of just breaking the contract by not giving any notice and forfeit my deposit and take her out this week and ask a relative to have her.

My husband think all the women there are sour face cows and to be fair they aren't very smiley and warm!

Any advice?

Take her out.

WHy send her somewhere where the staff are "nor very smiley and warm"?

You will have to give notice though.

You'll have to pay for the notice period - or is that covered by the deposit?

you will have to pay the notice period. it will be in your contract how much that is. probably a month's fees.

I paid £100 deposit and her fees are £88 per week. I'm just thinking what would seriously happen if i broken the deposit and took her out without notice? Do they have any legal ground?

what do you mean broken the deposit? do you mean contract? if you take her out without notice OR paying the notice they can take you to small claims court.

If you signed a contract with a fixed notice period then, unless you can show they have broken the terms, they can legally demand notice or fees in lieu so chase you for £88*4 less £100 deposit.

If you took her out without giving the notice you agreed too then don't be too surprised if they pursue you through the small claim courts.

I am sure you wouldn't like it if a nursery gave you no notice of it closing.

To be clear they were ' smiley and warm' when showing me around and settling her in otherwise i would not of put her in! -But yes i would not like it if the nursery closed without any notice. I need to get to the bottom of why she doesnt like it.

If she doesn't like it take her out - but you will have to pay as per the contract.
