Hi,
I lost the appeal for high rate motorbility for my son at a tribunal. I have the upper tribunal coming up in just over a week.if anyone has any advice for me, it would be much appreciated.

Why does your son need it?

Why does your son need it?

Oh yeah, it would be helpful if I had said 😁.
My son is autistic. He has just turned 8 years Old and attends a special school. He was diagnosed at 4 years old. He has no sense of danger and will run at any opportunity, he throws himself in the floor of he's having a meltdown down. If we walk to the local Parke 2 of us have to go as we feel it's not safe enough for just one of us to go as he is strong and if he tries to escape, for instance if he sees a dog that he wants to pet. He will do anything in his power to to get to that dog. He doesn't understand the danger of cars/roads/water therefore we have to drive to the parkway which is.only 5 mins on foot. We have tried reigns, which obviously help but it doesn't stop him trying to run and throwing himself about .

What were their reasons for rejecting the claim

Are you at first tier tribunal (after the mandatory reconsideration) or upper tier.

First tier you need the arguments about the level of needs your son has.

At upper tier it’s about what legal mistakes the first tier made. Your son’s disability may be partly relevant but if another reasonable tribunal might have decided in the same way (and no mistake about what the law says) it will not succeed. Scope on upper tier
