Cod or anyone, can you tell me about liability orders?

Hmm, not a very happy bunny!

We were late with a council tax payment in June, which was paid after a warning letter, however in the meantime a letter was sent to say we have now lost the right to pay by installments. After ringing, ringing and ringing again, all morning actually (no decent phone system Grrr) we got through and was told if I made another payment then for July's council tax and set up a direct debit mandate I could continue to pay by installments.

One hastily sent of DD form later (I even put it in a first class envelope rather than use the 2nd class pre paid envelope. But, with all things done in haste, I messed it up and did not sign the mandate. Anyway, sent it back off again promptly (although looking now the second class post meant it took 5 days to arrive . This was three weeks ago. Got the summons to court on Sat for the end of the month.

Is it the norm that I get this summons with a letter basically informing me I can't argue the case at all? Telling me that if I don't inform them that I wish to come there will be severe delays?

Anyone have any thoughts?

Have you rung them again since they sent the summons ??

Kelly1978 · 15/08/2005 12:03

You cant argue the case, because they wont be interested in the reasons why you haven't paid, jsut the fact that you haven't.

Kelly1978 · 15/08/2005 12:05

If you don't want to go to court call the baliff's office or the coucil who are dealign wiht it, and discuss it wiht them. It might not be too late.

Flossam, when i had mine I rang them and re arranged how much my payments would be for (quite alot more though) and then set up a Dd and they were fine about it.

Flossam · 15/08/2005 12:24

Managed to get through and they have recieved my DD form. Although according to them it took two weeks to arrive and I should have hand delivered it, even though it is in another town. They will review my case and reach decision by the end of the week. A payment is due today which I thought I might make regardless - kind of showing willing? In the hope that it might go in my favour. What do you think?

I would make the payment.

nutcracker · 15/08/2005 13:02

If you have the money and won't be going without anything serious then I would definatly pay it.

Flossam · 15/08/2005 13:32

All done. At least then if nothing else then they can only now demand £670 odd quid off us now. Thanks everyone.

Jusgt thought I'd update for any interested. They have accepted out DD form and we didn't have to go to court or pay for the l order. Very pleased.
