DH laid off advice on benefits pls

DH has been given 2 weeks notice today

He has been working as a labourer for a builder since Jan 08.

Does anyone know if we would be entitled to any benefits?

I work for 18 hours a week but I can reduce my hours to 15 if it helps to be under 16hrs/week.

We have £4k savings.

We have 1 DS in nursery and were getting tax credits to help us pay for his place but these will now stop so we will have to give notice

I doubt we can claim HB becuase my mum lives with us and she has a good pension.

C Tax benefit?

Jobseekers Allowance for DH? Work might pick up, so I'm not sure if he's been sacked/made redundant or what?!

Grateful for any advice.

Actually, it's usually now known as Local Housing Allowance.

If you are a council or HA tenant, you can elect to have it paid directly to the landlord.

I totally understand she will be factored in, that's why I said we probably won't be entitled to anything in my OP.

I am not trying to get anything that we are not entitled to, just do the best for my family.

As others have said, there are various ways of doing things, ie. reduce/increase my hours at work.

You can reduce your hours.

It's important, however, to figure out what exactly, if any, difference it will make to you.

As pointed out, even income-based JSA, it might be better to maintain your hours and claim more tax credits, particularly if you might not be entitled to LHA/HB and/or CTB.

You can still get free prescriptions and dental care on Working Tax Credits.

Also if you work over 16 hours then you can claim from the working tax credit people for up to something like 80% of your nursery fees, i would not be cancelling the whole nursery side of things if you don't need to, phone them tomorrow and explain what has happened, surly you can get child tax credits and working tax credits if you work over 16 hours?

onadietcokebreak thank you for being so helpful. He won't have the contributions in 07/08 as he only started work in the September/October so IB is probably the only way....

expatinscotland don't worry, I will be informing tax credits that DH has lost his job on Friday. I am not trying to get anything I am not entitled to here!

I never said you were. Just that, having dealt with them myself, it makes sense to cross all the t's and dot all the i's because you can't be too careful as they can and will claw back if they determine things have gone wrong.

Does anyone know if tax credits will use:-

a) last year's joint income of aprox £16,000

or

b) current income of £5116 (if DH were to be unemplyed all year)

I did mention before that on the site it says you can give this year's income if it is less than last years.

Obviously I hope DH won't be unemployed for the whole year, but then when he does get a job, I would call them with revised figures.

You are right about the childcare. Does you child qualify for any free funding yet?

Hopefully your partner will pick some work up so. Horrible situation to be in and he must be feeling low at the momemt. Look after each other even when you are pulling your hair out from the all the red tape and form filling. x

Personally.....I would use last years figures. Otherwise you are going to be in financial hardship if they cut your CTC or even stop it when partner finds a job.

What is the difference in CTC amounts the site gives your?

Sadly DS is not yet 2 so will be September 2011 before he qualifies for a free place. The 4 weeks grace period is good though, as most places would have a 1 month notice period I imagine, and 1 month's fees would push some ppl to the edge!

Fingers crossed something comes up for him!

Has he got redundancy payment form his employer ? If he has worked there for 2 years then he should get some.

Have a chat with your local council to find out if they do the early years two year funding pilot. Very Very limited and strict criteria worth looking into. Also ring your local family services and find out if there is any convergance funding for childcare help...again a long shot but worth asking.

Also, even on last year's income we still qualify for £1.02 WTC which I am guessing entitles us to free prescriptions?

notapizzaeater no he hasn't got anything, despite working there for 2yrs 2mths.

I think he has just been fired though, not "made redundant" - what's the difference?

The letter his boss sent said his "employment has been terminated" because there is "no work for him" (their words)

I think you need to do it for next tax year to get a true reflection. You get a choice to select tax year 10/11 I think??

gossipgirl it will make a difference to the jobcentre... you might have to take the letter to show them for them to make their own judgement?
Also, jobcentre will contact his old employers to confirm the reason for him not working any more (only know this because I had to fill in 2 of these forms when our business closed for the winter, it is seasonal so our staff were all on fixed term contracts)

They can't just fire him because they have no work. I would phone ACAS in the morning. They need to follow procedures, warnings etc

Someone might be along soon with more details about this (or post on the employment issues board) I think he should be entitiled to 13 weeks pay in lieu of notice, holiday pay and 2 weeks pay for the 2 years service (tax free) so well worth chasing.

I don't think he has much holiday as he took 2 days inn February.

please read this

your dh has been working there for over 2 years. he has been made redundant. there are procedures his employer needs to follow. your dh is entitled to redundancy pay and notice pay.

this is how it's calculated

he's only 'fired' if he's done something wrong.

if the comapany have no work, then he is redundant.

Right, DH is really finishing at the end of this week.

Can I ask how I make an appointment with the Job Centre? The online claim form doesn't allow claims if you have a partner, so should we just ring up on Monday (1st day of unemployment) or can you ring ahead of time?

Do they do it on the phone or do you have to go for an interview?

Will they tell us what we need to bring with us?

Sorry for so many questions!!!
