can non-resident parent claim CTC?

sudenly saw credit from child tax credit (£200+) in joint account which still have with exP - this account pays mortgage for joint owned flat plus some DDs for joint owned flat he still lives in.

i moved out in 2008 and rent, ctc was zero but i did inform them i had moved out with dcs.

i have residence order in my favour, he sees dcs alternate weekends and weds eve day time only right now . no overnights yet.

so is he legitimately claiming CTC?

should i ignore it, as his affair ??
he isnt working and i believe is claiming employment support allowance... he pays nothing to me for DCS.

  • but seeing as it goes in joint account i am somehow complicit if he claiming on basis he is main carer - when he clearly isnt?

or dont they care?

Child tax credit is paid to only one parent/carer.This is the person who is mainly responsible for caring for the child or children.If you are a couple you have to claim jointly or its the person who the children live with who claims.

I think that your exP shouldn't be claiming.Are you sure it was child tax credits and not working tax credits?

cestlavielife are you claiming child tax credits yourself for you DC?

i am not claiming CTC. or WTC.
(my salary is over the amount and is from international employer so diff tax regime anyway)

when we lived together it was naturally a joint claim, when we were both working there was a claim (when they replaced the child tax allowance with CTC) . in 2008 i informed them i had moved.

at that point when we both worked we got the minimum amount £10 per week. then it had been a "zero" amount for couple years anyway.

tho they kept sending annual forms confirming no change.

in 2008 i informed them of my new address and that we were separated for the record. but didnt claim as such - as was zero anyway.

he isnt working now so cannot be wtc?
he offically gets a very small income from joint owned flat which is rented out but the income after taking out mortgage payments is pretty much nothing (after dividing between 2!) and i dont think that counts as "working" income anyway? he had told me he was claiming ESA and had asked me for paperwork on the flat as they were going to cover some of the interest payments on the mortgage for flat he living in?

but it said "child tax credit" not "dwp".

dont know if i should contact them or not?

trying to get sale of both flats to separate completely financially and close this joint account...then it really isnt my business. but is going into joint account so has implications? or i just ignore? (the joint account is heavily overdrawn due to his spending, no point me putting it in credit he would just spend it....)

think i would worry about the implications of having to pay it back if its in a joint account can you be personally be held resposible for the money?

If he isnt claiming Child beneift for that child he shouldnt receive CTC.

However it is non unheard of for non resident parents to fraudently claim it.
