Hi I am in a bit of a dilema. I used to run a business with my partner but left last MArch as I hadn't been paid for 3 months and had to find something that was secure.
she paid me drips and drabs for a will and in October I set up a signed agreement that she would pay me back £66 a month for 10 months. (£660 owed in total)
She pays £20 into my bank account and I pick £46 in cash.
This was fine for october and november but dec only £20 went into bank. She kept saying she didn't have cash. I have rung every week since and this week she agreed to write me a cheque for £46 last month and half of this month.
Paid it into bank but this morning it came back in the post - bounced!
So she now owes me £46 from last month and on 27th will owe me £46 for this month plus I have no idea if I will get £20 into my bank.
She still owes me £508.
I need some advice.
Can I demand the full amount? I am worried the business is going down the drain and I will never see my money. Please help!

Were you self-employed or an employee?

employee.

Ok, that gives you more rights. You can put in a claim for "unlawful deduction of wages".

What I'd do is write to her, telling her that you plan to make a claim for unlawful deduction of wages unless she pays you the money she admits she owes you by X date.

If she still doesn't pay up then you can take her to an employment tribunal but that could cost you more than you'd get back in fees. You may have to write the debt off.

Do you have anything in writing from her admitting she owes you this money?

You may be able to make a claim in the small claims court but I'm not sure about that.

I have a signed agreement with her that she owes it and I have the wages slips from last year with the bank statements showing it did not go into the account.
Thanks for the advice.
Can't see her being able to pay the debt if a £68 pound cheque bounces.
