council are trying to take my home - help

i moved into my council house on the 2nd may which is the same day my son was born. As a single parent on smp i am entitled to almost full housing benefits. I applied and was told that they were jsut waiting for decision from working tax credits. Working tax credits have mesed up and although i have been given an award they cnt say how much or when it will start and are trying to make emergency payment, holding up the housing benefit. Because i am waiting for this to go through obviously rent is held up. Recieved a letter from housing officer this morning who does know the situation and has been given full authority to check out the problems saying that they are giving me notice to quit the propert - making me homeless because my benefit hasnt gone through yet cannot be legal. If this happens i will have to give up my son becasue i will have nowhere to go. someone please tell me if they knwo of a solicitor who can help or what to do - this seems so unfair!!!

I work for HA (like Custardo - no an HO. Agree with what Custardo & Bojangles have said. What happens with shorthold is that the Court has to grant the eviction if there are arrears but you still get 28 days AFTER the court date.

I have known of HAs who have standard computer letters that threaten eviction & go out if the HO forgets to cancel them but I guess you've been in touch and this isn't the case.

Would it be possible to get anything from HB to prove you are going to get full HB even though they haven't issued payment yet?

Keep talking to the HA & HB. Keep calm but persistent. Lots of help here on MN, so if you need it, just shout. Good luck.

hi guys. it does seem to be standard procedure. my mp, social worker and shelter are now all involved and i have a meeting wiht her on monday to discuss in more depth. dont really want to see her but there you go. i know she rang hb to get an update but while she was at it started speaking ot council tax as well - why none of her business!!!!!!!!!!!! . wtc have now gone through after i shouted and told them i was going to the press at the end of that day if they didnt get on with it, i dont like being like that but it jsut seems to be the only way. Apparently my hb claim has been taken over by someone elser now and she wants loads of different info and is horribly patronising but if she gets it done i dont care! i jsut want to enjoy my time in my home with my child without all this crap!!!!!!!!!!!!!

As explained in my earlier email, I am writing to you regarding a situation that has arisen with the council regarding my tenancy, which they are trying to end due to housing benefits not having gone through.

I moved into the property on the 7th May, 5 days after the birth of my son. A single, working parent, although I claim no other benefits money is tight, I did apply for help with the cost of my housing. The council?s calculator worked this out to roughly 95% of my costs, along with working tax credits.

Initially the problem with the claim was that working tax credits did not go through quickly enough, however a second woman took over my h.b. claim and as so often happens, communication was not effective between the departments meaning that I have had to resubmit certain information. The only thing now outstanding is a certificate of earnings from my employer.

Because of previous problems as a young adult I am classed as a vulnerable adult (I suffered from depression), and was priority need for housing as a result of both this and as a result of having my son. Apparently my Housing Officer (Sarah Baxter) is aware of this, as she was also aware of the fact that I may go slightly behind on the rent whilst I waited for these claims to go through however this was not taken into consideration, as apparently it is policy to serve notice to quit in these situations.

A meeting is arranged to discuss this with miss Baxter on Monday 10th at 11, however even if there is a favourable outcome, having spoken with many other parents in similar situations to my own, I am not the only person going through this or a case like it. I feel that it is disgraceful that it is par for the course to threaten the security and stability of the most vulnerable members of society in this manner. I am not a couple or even individual who has chosen to default on the rent, nor am I one of life?s spongers who floats past thinking the world owes them a living and neither are most of the people who are applying for or receiving this help. I am simply a young woman with a small child trying to work her way through the maze of beaurocrasy that seems to be the most prominent element to all of this. I feel council policy should change and that pressure should be placed on the departments to improve efficiency and the manner in which these cases are dealt with.

Thank you for your speedy response in this matter and I will speak with you shortly to let you know the outcome of the issue.

Good for you, prettyfly.

That is absoultely ridiculous that a person has to get an MP involved in order to get the tax credits which they need to live in a timely fashion.

Great letter. Hopefully will have an effect.

I don't know how much credence some of the people within HB give to depression; it was depression that triggered my hubby's illness that in turn caused him to lose his job, and default on the rent whilst everything was sorted (We owned half our house so that made things a little more complex). I wrote to them (rent in both our names) asking them to deal with me only as hubby's condition was so bad, but theyr efused ther equest and kept visiting him when I was out.

Amazing what they can get away with
We ended up selling our house and moving into private rented accomodation; a week after we moved we had a letter saying we'd been underpaid HB, the difference could have saved our house [sad[

WHICH is why I am so detrmined the same ain't got happen to you

peachy thats shocking. it just seems like such a visious cycle where vulnerable people are victimised and those willing o help themselves are given everything- and its all so confusing. i am about to do my degree for g sake so i am nowhere near stupid but i struggle to keep up with it all!!!!!!!!!!!!!!

The other person you want working in your corner is your local councillor. Much neglected of late in politics, any issue within a local authority and councillors can (if they want!!) get things moving along pretty quickly. Should be able to get a phone number / email address etc from your local authority website.

Just remember that the people that do give a damn tend to be those who need public support come election time.

prettyfly1....your post makes me . im in trouble with my rent too. i have always worked, got made redundant and was out of work claiming benefits for ten months. i finally got another job and after three months of working there, the inland revenue still had not sorted out my tax credits claim. i was PAYING to work. i seemed to have so much going on, and so many papers lying around that i just could not sort ANYTHING out. nothing made sense anymore. i am now in quite a bit of debt thanks to IR and to top it off, just got made redundant again so not much chance of paying anything back in the near future. i had bills based around how much i would earn...and that included tax credits. without those tax credits, i couldnt pay the bills and various things have gained interest. i could put the calcs the IR have sent me into a book format and send it off as fiction im sure. (ive even had three kids at one point apparently...not sure where the other one came from). i could scream...for you, me and everyone else the IR have messed about. these are people's lives they are playing with. rant, rant, rant...[bangs head against wall].

and they want to encourage single mothers back into work? what a larf.
