Where do I stand regarding loan??

I am currently separated from H with the divorce petition due out any day.
I am living in the Matrimonial Home with the children and have no debts, I am currently paying the mortagage, and all bills
He is paying maintainance, and his inclusive rent in a shared house.

He has taken out a loan recently - I have no Idea of the amount, I have no idea if this loan is secured on the property and am concered that if he defaults I will lose my house.

Also will this be taken into account as a joint debt when all the money stuff is sorted out in the divorce

He cannot secure a loan on the property without your signature surely?

If the house is in your joint names then surely, as corny says, he can't have taken out a loan against it without your signature?

Thanks I have no how idea how the big stuff works and Am mainly anxious as although I know he has the loan I have no idea how much it is for.

In my innoncence I thought that if you were classd as a homeowner( which he is atm) then any loan via a bank etc was automatically secured on that property

You can check with the Land Registry whether a charge has been secured against the property.

unfortunately he can if he forged your signature it happened to me my ex took out a £10 000 loan from a well known firm W....finance they gave it to me since i was the one paying the mortgage and it was difficult for me to get it i was asked by the judge what do you want to do pay the loan or sell the house and payoff the loan the chances of getting another mortgage was basically ZERO and i worked damn hard for my house so i agreed so im stuck with the loan its a struggle some days i ask myself was it worth it keeping this loan. and the cheek of it he went back to the finance company and told them that since he has been very good at paying his instalment can he have some more stupid them almost did i only found out whe they accidentally sent the forms to me and i blocked it

Have you officially separated?

Debts are taken into account on the day you officially separate. For example if you have a £1400 overdraft on 2 January and that is the date you split then that is what is taken into consideration. I would get thee to a lawyer double quick to clarify this but from what I went through I don't think it should count against you.

unfortunately my ex was a sneaky bastard when he left he told me he needed some space that week thats when he did it he was so nice to me even came back home to look after DD while i was at work,after a couple of weeks thats when Mr Nasty came out my solicitor wasnt that good either so he got away with it i will remember next time if there is one
