Any advice re- seperation and finances please?

Hello all,

my hausband and I are seperating. It is his idea, but I need to accept this is what's happening.

He is the sole earner, we have a joint mortgage. I last worked 6 years ago.

We are currently still sharing the family home, and it is incredibly difficult.

I am applying for jobs- but until I get work-does anyone know if I can sign on or claim any benefits, particularly as we are still living in the same house? Ideally I would like him to move out, but I may end up having to leave as he has threatened he won't move out, even though he has decided he wants us to split up, he isn't interested in sorting anything out between us, in fact I don't think he wants to....

Any advice please? I am going to see CAB next week..

Hi, couldn't let this go unanswered but you'd be better off posting in legal as lots of family lawyers 'hang out' there.

Most important bit of advice I can give you is DON'T move out. If you move out of the matrimonial home he has absolutely no incentive to try to resolve matters amicably. Also, where would you go? Presume you'd want the children with you so you need to stay put in the matrimonial home, even though it must be an awful situation.
If it is him that wants the separation, let him move out.
Unlikely you'll get benefits whilst still living under the same roof if he is still carrying on paying bills etc.

You need to consult a family lawyer, preferably a member of Resolution, an organisation that try to promote as amicable a divorce/separation as possible. Very important when there are children involved.

You should also try to find a solicitor that has a public funding (legal aid) franchise in case you are eligible
