I am writing in reply to your recent letter regarding overdue rent. I am currently waiting for conformation of my transactions from my Barclays account into the accound of the Dunning Will Trust, as, despite having made several payments on top of our regular rent the 'overdue' amount seems to have suddenly increased again.
As soon as I recieve documentation of my payments from Barclays I will contact you again to arrange payment of any overdue monies.

I have also had an inspection carried out by our Health Visitor with regards to the damp in the house which is still prominent in the middle room and bathroom. My 3 year old daughter has now been diagnosed with asthma and it seems to be the dampness of the house which is the prime cause of this. She is now having to be referred to a paediatrician and asthma specialist.
Despite blocking the front of the house where the rain was getting in, there is obviously water lying under the house as we re-painted all the walls after you addressed the problem but the paint has again come straight off where the walls are wet.

We are also awaiting a visit from Environmental Health with regard to the garden and the rat issue. As I wrote in a previous letter to you, after the poison was laid, the garden was never checked for dead rats or for further runs. Residents from further up the street are continuing to leave rubbish at the end of the garden on a weekly basis which is sure to contribute to rats coming back.
The property is described as 'with a garden' but due to no-one bothering to sort the rat problem we have no garden which, with two young children, is a major problem.

There is also another problem a little further up the alleyway - one of the residents has taken to hanging pheasants to a pole across the alleyway which is not only disgusting to see but will also attract rats.

As soon as we have had these visits and had paperwork returned from Barclays with regards to the rent I will contact you again.

Just because your landlord has threatened to kick you out if you do not pay £1800 does not mean that the matter ends there.

Assuming you don't pay the £1800 and you leave on the 31st they are unlikely to forget about the debt. They will certainly keep your deposit and offset that against the money owed. You will probably get rude letters threatening court action to recover the debt from the agents and no doubt their solicitors. They may have a case or they may be trying it on, they may capitulate without a fight or they may pursue it - its obviously hard to tell. Probably as you have not given notice they may try and claim 1 months extra rent as well - not sure if that would be enforceable in your case but probably would be.

But i can;t really give you any advice as not my particular area of law and don't know all the circumstances.

Agree with Kaz33 - would be very surprised if he didn't come after the rent in lieu of notice. Could you not issue notice now.? Have you had previous warnings re:arrears which may make his deadline enforceable.

I would suggest that you try to make some sort of payment in the meantime just to keep him at bay and get advice from somewhere like CAB.

tbh he's so arsey we aren't bothered if he keeps the deposit, we just want to get out of his house!! Our neighbour was telling us about how they are with them and told us to just leave the keys with them and go!!!

Dont make the mistake I did, You must hand him the keys and get a reciept for them otherwise he could claim that you never handed them back. This is what my ex-landlord done and he claimed he had to change the locks. Because of this, I was ordered to pay extra rent and the cost of changing the locks.

Oh pants. Didn't think of that!!!

He left a mesage on dp's phone at the weekend saying that he would start proceedings to get us out on Monday (today).

Do you think sending this letter will bide us some time?

Also how long do 'proceedings' take and will we get an option to defend ourselves or is it just a case of him getting a piece of paper that gives him the right to throw us out tomorrow??
