Farking student loan company has sent my details to a collections agency who are phoning and leaving messages on my machine 3 times a day, letter to say they are coming to visit. Is this harassment?

I'm out all day from 8am, back about 7pm so can't call them back. The SL screwed up as they were sending letters etc out to an address I lived at 10 years ago, despite me having a loan at my current address so they knew where I was. They have sent my details to a collections agency, I have spoken to them and they have told me they are going to send me an income/expenditure form which has not turned up yet. I have tried to phone them when I can but I always end up being cut off. They are phoning my home phone and leaving long messages (tape recording type thing) 2-3 times a day and they are taking up all the recording time on the machine. There's another 3 today and a letter telling me to phone them within 72 hours (dated Saturday) or they will come out and visit. Are they allowed to do this I feel harassed by something that was not my fault. I called the SLC repeatidly to reqest deferment papers, they were all sent to the old address.

not sure what constitutes as being harassment.

they will call and call and call though,i know that much. just do your expenditure on a piece of paper with a covering letter.

Thanks. They are really starting to piss me off now. I'm so busy working so I can pay the bloody thing off!

As far as I know they are not allowed to harras you on the telephone at all. Can you switch the answermachine off.

Don't ignore it though.

Also, if they come to your house they are not allowed access without a court order - again that is as far as I know.

Send them a letter with your information but send it recorded delivery so you know they need to sign for it.

So is it the agency that is calling you not the SLC? And the agency that is threatening to come around? If so then I would write to them, stating you are requesting the income/expenditure forms, please send these. Also state that in the meantime they should not attempt to contact you by telephone or in person and that you will only accept contact at your current address by letter. Send this by recorded delivery. It is important you respond to letters from them promptly though.

Hi, you need to visit the consumer action group forums, they have folks on there who are going through the same thing.

In the terim, do send them this letter and hopefully it should get them off your back:

Dear Sir/Madam,

Harassment by telephone

FORMAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 2006 COMPLAINTS PROCEDURE

Account Number:

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

I have verbally requested that these stop, but I am still receiving calls.

I now require all further correspondence from your company to be made in writing only.

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

Be advised that any further telephone calls from your company will be recorded.

I've escaped early today! Wehey!!

I called the SLC to moan, they said there's nothing they can do but if I ignore them for another month they will send the account back to them. I've posted the collections agency a letter of complaint.

Thankyou for all your advice. It's really appreciated.
