Help, website price wrong on goods already ordered

Does anyone know what happens if you order something on a website (large purchase, lots of money!) and the order goes through, you get confirmation etc and then they tell you (2 weeks later) that the price was significantly incorrect?! We are left with the choice of paying more or not having it.

Their terms and conditions seem pretty foolproof, but having a quick google, there seems to be instances where the T&C's can be overruled iyswim. Would really appreciate any advice

I don't think they have any obligation to provide you with the goods at the incorrect price I'm afraid.

I've heard of lots of cases of mispricing on sites picked up by sites like moneysaving expert so loads of people order and the website hasn't delivered at the wrong price.

It depends on how they worded your order confirmation. If they have taken your money and confirmed that your order has been accepted they have to send you the goods.

However, if their 'confirmation' emails say that the order is not confirmed until they have taken your money etc then they are under no obligation to provide you with the goods.

We had this a few years ago with a posh king-size memory foam bed that was on sale for £400. Not surprisingly when the company realised that the bed should have been well over £800 they didn't want to send it but because they had taken our money and confirmed our order they had no choice but to send it. In the eyes of the law they had entered into a contract with us to supply the goods at that price.

Most websites are savvy to this now though so will state somewhere in really small writing that your order hasn't actually been accepted until they take your money etc.

Thanks trixymalixy and lottiebunny! No, they haven't taken any money though we have spoken several times to staff about the order and received confirmation ( from a member of staff, not automated)

Am so annoyed it had taken 2 weeks for them to get in touch about it and also that we now don't know what to do.

Was your confirmation in writing? If not they can just deny. Its a pita but for some reason they have more rights than you until they form a contract with you, usually at the point that money is exchanged but online they can make the point a contract is formed so much later than it would be in a shop.

Yep, got it in writing with an order number and expected date of delivery,from the same member of staff that we have spoken to. But, no money had been paid out.

I would suspect that until money is exchanged the contract isn't formed but it might be worth taking to CAB to see what their opinion is.

Depends on the site, most have pretty water tight T&C's and state no contract is formed until the item is despatched. Up until that point its just an invitation to buy and the retailer has no obligation to honour a price error.
