I bought some jeans from M&S last July and wore them for the second time recently. When I pulled up the zip the whole little tab thing came off so I was (embarrassingly) left with a gaping fly while out and about as the zip couldn't stay up without that piece.
I still have the receipt so took them back to M&S the other day and I have to say it was a bit farcical so I need some advice.
First they said I was out of time to report them as faulty - even though the first person I spoke to said she could see they'd hardly been worn, and that they still had the manufacturing stickers inside them ie they hadn't even been washed yet - and then the supervisor went on to say if they were going to do anything they would have to send them away to a technologist to determine whether there was actually a fault!! I politely pointed out that a zip breaking in this way didn't really need expertise to diagnose it as a fault, particularly as I still had the little tab bit which showed it had a tiny bit of metal to hold it to the main zip bit that goes up and down.
Anyway, I always understood that if an item was not fit for purpose ie it didn't work as you'd expect it to (and for £29 I expected these to last!) then a replacement, repair or refund was in order, and there is no time limit as long as there is no unreasonable wear and tear. Am I right or wrong and where do I stand on this please?
